$3 million award for bar, lot stands

Joseph and Mona Nemer scored a big win Monday, when a Summit County Probate Court judge denied a request from the University of Akron to retry a case awarding the couple $3.1 million.

As for the monetary award, having been through the E.D. process many times; I am still rather surprised at the amount, but ultimately the process has performed as it should, the property owner received due process and was rewarded by a system which protects a property owner's rights....we all should be thankful we live in a country such as the United States !

What you are failing to admit is that if you were a businessman offered a fair price for a run down building and help in relocating your business for the good of the community...yes...growth at the university is for the good of the community you would accept that and not be greedy and bite the hand that fed you for those 30 years. Millions have been made by the Nemers and they could take the money...reopen downtown....and make even more as the projects by the university will provide both more people living in the area and more traffic during the football season.

This is greed not good business.

This is a victory for the common man over the government use of eminent domain. I applaud the judge for his ruling. Stealing one's real estate by eminent domain is just plain wrong. The UA should have made a fair offer for it to begin with.

Good for the Nemer's. They are 2-0 in the courts.

Now we'll see iff'n Akron U really wanted that property. Iff'n they bail out because of the court order, then it shows that they didn't really need it and have abused the ED laws.

Was reading over the comments- To 'Truth Hurts' you must not know the definition for 'Fair Market Value'-so I will help you out- Fair Market Value is the price at which a property is transferred between a willing buyer and a willing seller.' ummmm....'willing seller'..... or 'The highest price a willing buyer would pay and the lowest the willing seller would accept.' So by definition, the ruling has determined the Fair Market Value-the price a willing seller will accept. ED is hard because you usually don't have a 'willing seller'.So the term 'Fair Market Value' is skewed, by all means.

Totally not true. A part of ED is that UA has the righ to bail. Just because I may need something doesn't automatically mean I need it at any cost. Stop your childish analysis.

Way to google a definition there Mike, but let's be honest, the best and most accurate definition...
"An appraisal term for the price which a property would bring in a competitive market, given a willing seller and willing buyer, each having a reasonable knowledge of all pertinent facts, with neither being under any compulsion to buy or sell."
Shows what FMV really is. The value of land when neither party must buy or sell. Since The UofA needs the property, they should have to pay and exorbinant amount, or be extorted by the seller.

I hope UA holds to it's promise to walk away at this price. Nemer's claim it is what they want (doubt it), call their bluff.

The University offer was based on a number of very qualified, highly trained valuation experts. They are called appraisers. They/we don't appraise high or low. We form opinion of value based upon market data, current economic conditions, etc. that is "credible" (defined as worthy of belief).

The Nemer's "expert witness" was a so-called local broker. Never heard of this guy. How did he get admitted as an expert witness? Has the threshold of qualifying as an expert in court testimony fallen so far? He speaks about a very convoluted sale of the Jillians/Brubaker property and claims that to be the market value of the Sun Grill property.

I think the only close to accurate part of the award was the parking lot area.

Thank you. You are absolutely right. In most cases when it comes to eminent domain, the homeowner, or business owner in this case, has not even thought about selling. Most business owners realize that selling and moving a business is quite complicated. It takes a great deal of planning. If not done correctly, it can jeopardize the entire business. Location becomes a major factor, regardless of the condition of the buildings. Then you have other things at stake--moving, retrofitting of equipment, new clientel, adverising, and name recognition goes into the equation. Value is not as simple as some would have us believe. Especially when the business owner was not willing to move.

There's got to be some middle ground the two parties can find.

The two parties, without lawyers(sorry warner) should get together and hash out a deal, shake on it, then draw up the papers.

Both parties can turn this into a win-win scenario and move on. Talk is the key word.

A 3rd party really needs to open the door.
