A panel of federal judges has ordered that all federal Coloplast tranvaginal mesh lawsuits will be consolidated for pretrial proceedings as part of an MDL, or multidistrict litigation, and the cases will be transferred to the same judge who is already presiding over four other transvaginal mesh MDLs.

According to an order (PDF) issued by the U.S. Judicial Panel on Multidistrict Litigation on August 6, the Coloplast pelvic mesh litigation will be centralized before U.S. District Judge Joseph R. Goodwin in the Southern District of West Virginia.

There are currently at least 24 lawsuits over Coloplast mesh filed in U.S. District Courts throughout the United states. At least nine of the complaints also involve other transvaginal mesh products that are already pending before Judge Goodwin.

All of the lawsuits involve similar allegations of design defects associated with transvaginal mesh and bladder sling products used to repair pelvic organ prolapse (POP) and female stress urinary incontinence. The use of pelvic mesh transvaginally has been associated with reports of pelvic pain, infection, migration of the mesh through the vagina and other complications.

It is common practice in the federal court system to centralize complex product liability lawsuits involving problems with similar medical devices manufactured by the same company. Consolidating the cases as part of an MDL during pretrial proceedings helps reduce duplicative discovery, eliminates conflicting rulings from different judges and serves the convenience of the witnesses, parties and the court system.

The Coloplast mesh MDL will become the fifth such litigation centralized before Judge Goodwin, who is already overseeing similar MDLs established for Bard Avaulta lawsuits, Boston Scientific pelvic mesh lawsuits, Ethicon/Gynecare mesh lawsuits and American Medical System (AMS) lawsuits.

A sixth transvaginal mesh MDL, which was established in 2004 for lawsuits over the Mentor ObTape, is centralized in the U.S. District Court for the Middle District of Georgia. However, most of those cases have already settled or resolved.
Transvaginal Mesh Litigation Continues to Mount

The number of transvaginal mesh lawsuits filed against different manufacturers of the pelvic repair products has increased in recent years, as public awareness about the risk of complications from vaginal mesh and bladder slings has increased.

In July 2011, the FDA issued a warning after receiving at least 2,874 reports of transvaginal mesh problems between January 2008 and December 2010. After a review of all available data, the FDA concluded that there was no evidence that vaginal mesh provides any additional benefits when compared to more traditional surgery for treatment of pelvic organ prolapse.

Earlier this year, the FDA sent a letter to several manufacturers of these products, ordering that they conduct additional studies and trials to evaluate the safety of transvaginal mesh products, and establish whether they pose an unreasonable risk of injury for women.

In the face of mounting litigation and the required studies, several manufacturers have decided to stop selling the products. In June 2012, Johnson & Johnson’s Ethicon subsidiary announced that they were removing Gynecare transvaginal mesh from the market, and asked the FDA to place a hold on any requirement that they actually complete the ordered studies. C.R. Bard has also reportedly stop selling their Avaulta pelvic mesh products in the United States because the FDA was requiring the additional studies.

Last month, the first transvaginal mesh trial held in the United States resulted in a jury award of $5.5 million in California state court, involving a lawsuit over C.R. Bard’s Avaulta mesh, which sliced through the plaintiffs colon, resulting in the need for eight additional surgeries.

I had a ventral hernia repaired in 07. In 08 the surgeon went back on the add a second mesh. In 10 a went under for a third time with a different doc. He needed to reatch mesh tp Coopers Ligament. I have had pain on and off for two years. CT scans are "NORMAL". on Sunday I was hit with a white hot stabbing pain in the area where mean is anchored into the pelvic bone. The pain got so had iwent to er knowing I do not have insurance. Daludid every two hours and a two night stay earned me a "chronic pain" sufferer. I want the mesh out by docs say it's not the mesh. Is anyone aware of complications or litigation with the paritex mesh products?? I can't find anything on a recall

call Dr. kevin Peterson in las Vegas nevada. His office is no insurance surgeries. he is an expert on meshes, he may help you by reading your ct scans and giving you his opinion.

Are you kidding me?? we have been trying for months to get an attorney to listen to us about this, Ive alreedy contacted Doug Kreis and havent heard back from them yet.

I hope the Vaginal mesh cases go better than the Hernia mesh cases. They are being set up the same exact way the Bard case was set up and I have not read one thing that indicates they went well for the victims. Went great for the manufacturers, lawyers and the FDA but not for the plaintiffs. Good Luck....

ones with new lawsuites have to ask many qustions wich they can gather reading this site and maybe they can or should get a deal in writeing from lawfirms that will make them fight and not throw there cases

Yes....unfortunately I do see what is comeing and it sucks. I have been dealing with mesh since 2006, I have been through EVERY MAJOR LAWFIRM in the country, I have presented documentation for OTHER lawsuits,I have shown through documentation the FDA is complicate in most of the mesh cases when it comes prior knowledge, I will never get restitution for what has been done to me and I read about new cases everyday and know what is comeing to most of those victims. I am in MUCH better shape than most mesh victims but I will never be as active as I once was, nor will I ever live without pain or the fear of this damn ring inside me finally breaking! THEN a lawyer might represent me. This new case for the Vaginal meshes will be handled, bobbled, leached off of, and finally what is left will go to those women who get the priveledge to have their case heard.( I mean that some women will NOT be within the "CRITERIA" to qualify and thus discarded.) Then the rest that are just now discovering what is happened to them or the women that are past the legal time limit will be S.O.L. just like the rest of us that were implanted with Davol products or Ethicon mesh. Its a scam run by the courts, the lawyers, the manufacturers and the FDA. The house always wins.....

Esp with the mesh activating the body's anti-inflammatory system which never ends, even when the mesh is gone. The body continues to build scar tissues and many times will end up with autoimmune diseases. Just from my own experience and reading others, even if the mesh is removed the nightmare doesn't end, just moves on to the next chapter. I was told if your body is not keloid prone, one does better.
Did you have to look for the Dr who didn't use mesh, I thought most did. Traditionally onl SKILLED surgeons repaired people but with the medical device kits, mesh or not, it seems average Drs who would not have performed surgeries are now doing it.
Again, I wish your husband receives the relief he deserves. He is a lucky man to have you.

I sure don't but I have had a couple that did not make it on the blog. I have written much more critical and somewhat negative posts without a problem. There seems to be no reason for them being discarded. Is the FDA surveilleing our little group here also? Wouldn't that be a hoot.....

yes, we did speak with Dr. peterson in Las vegas but the last surgery was so awful that he decided he cannot help my husband. Started with a tiny hernia,mesh failed so he had to put in a huge mesh. he got MRSA and he has just never recovered. he feels like he is dying . Its getting worse by the day.

So yesterday I got bad news from my doc. It has been 8 weeks since surgery and I am still in a: lot of pain. So, he says we wait one more month for inflammation to subside then put my on permanent pain management. By this he means have a anastesiologist go in an numb the whole area permantly. OMFG! WTF? he says that some nerves are probably hit or pulled by the 15 square inch piece of mesh in my belly. I don't want anymore narcotics but I feel like I can't live without them. Dear God, how am I going to live my life? I am on a 5lb weight lifting limit Indefinitely. This is going to make me disabled I just know it.
