The Upshur County Commission made its ruling in the contested election challenge for Sheriff between Chief Deputy Mike Kelley and runner up David Taylor Thursday.
The commission finds that state law doesn't disqualify Kelley as a candidate. Also they ordered that the true result of the May 8 primary is as previously certified by this commission on May 18. The case is dismissed with prejudice and the matter closed. Taylor's request to cover costs was denied.
The state's election executive committee will have to approve Kelley's withdrawl from the ballot. Once that's done, they will send the matter for the county Republican executive election committee to choose a nominee.
2 candidates have already filed papers as independents in November for the office of Upshur County Sheriff.
