If no one witnessed clark fire the rifle then in my opinion there is nothing but circumstantial evidence. Only reason this might have anyground is if test on the rifle said it was fired recently. But then agian its not illegal to own firearms yet thank God. Bottom line though if he was not seen then this should be dismissed.

Not really If the cops cannot put the rifle in his hands at the time the red light was shot out and a bullet from his gun as positively having shot out the camera or at best a clear picture or a video of him actually shooting at the camera they simply do not have a case.

If the video was tampered with, as he claims it was, then the grand jury is going to be forced to throw it out and let him go.

From what I was able to gain from the story the video shows him pulling out of a parking lot as the cops pulled up and arrested him and didn't show him actually taking aim at the camera nor shooting at the camera. As far as I can tell the cops are unable to establish the time frame the camera was shot out.

Now any reasonable person after shooting out something like a red light camera wouldn't stick around for the cops to show up. I know if it were me I'd be LONG GONE by the time to cops got there.

Regardless of what the guy is like, the one sure
way to determine if the gun in this guy's van shot
the camera, as the police alledge; would be to fire
the weapon and do a ballistics comparison to the shot fired and the damage on the camera!

Something seems squirrelly here. I am sure the
Knoxville Police have several CSI gurus that could
easily accomplish this task as it is not rocket science!

Is it possible the police do not want to do ballistics as it may show this was not the gun
used in this incidence!

If they cannot link the gun to the damage they don't really have a case, but then again the red light cameras are just a money making machine for the city anyhow, wasn't there someone who said the time of the yellow lights on the intersections with cameras had been shortened compared to the others, and also the cameras will also take your picture if you LEGALLY make a right turn at and intersection even after coming to a stop. something else to think about.

guilty of foolishness
I think he needs help.
Many of us have thought of taking a shot at the cameras
but most of us are law-abiding as well.
He's just silly.

Jim,

Yes really! Circumstantial evidence is good as good as any other form. In a case such as this, the evidence is pretty hefty. The guy is found near the red light camera with a gun in his van and 4 missing shells. The camera was supposedly shot 4 times.
