Ok, this is just a few pieces of information for those in Fortville who
somehow believe that the Fortville Police are crooked. Did you know
that it is "NOT" entrapment for a police officer to sit in a parking lot
of a drinking establishment? No, it's not! If you are going to repeat
rumors and old wives tales, then make sure that are factual! A police
officer in the state of Indiana may sit in a parking lot as long as he wants
for any reason what so ever. It is a public parking lot!!! Now, if a police
officer observes someone getting into their vehicle that "appears" to be
intoxicated they are not allowed to let that person get behind the wheel
of the vehicle and operate it. It is only entrapment if the officer gives you
the alcoholic beverages and then gives you the keys to your vehicle and
walks you to your vehicle. You (the bar goer) elect to drink on your own.
No one is forcing you to consume intoxicating beverages! Grow up and
take responsability for your actions! If you're not drunk then you won't
to jail for d.w.i. Now for the public intoxication rumor. Ok, how many
of you get boligerant when you drink, have bad balance, or maybe might
make choices that you normally wouldn't. If an officer stops you because
you appear to be intoxicated and you are not boligerant or show signs of
very poor balance then you will usually get thanked for making a good
decision to walk home and be on your way. Now do you realize that
if a police officer in the state of Indiana stops a person that is intoxicated,
wheather it be in a vehicle or on foot, the officer is putting his job on the
line....his home....and everything else that he owns. I say this because if
an officer stops you for d.w.i. and then decides to let you go and you go
off and kill yourself or God forbid another innocent person, that officer
is will be held accountable for that. So, when you are at work, do you
follow the rules......if so, then why? Because you want to keep your
job, ie income. So, that's why officer's do what they do. There are laws
that they must enforce. Just another footnote......If you were a hunter
would you go where you knew there were deer? If I were an officer I
would go where the drunks were. Why not stop the tragedy before it
happens? By the way, I am a vetran also. I educate myself on the law
before I talk about it to others. So go to your local library or on the
internet and educate yourself on the law. Don't take any angry person's
version of the law because they have been "picked" on.
I hope the Fortville Police put up record numbers this year on D.W.I.'s
and I hope you're not one of them but if you are.....tough! Grow up!!!
The legal definition of entrapment is as follows:
"Entrapment occurs when a law enforcement officer induces a person to
commit a crime and then tries to punish the person for committing it.
However, if a judge or jury believes that a suspect was predisposed to
commit the crime anyway, the suspect may be found guilty even if a
government agent suggested the crime and helped the defendant to
commit it." So.. do the police officer's of Fortville offer free alcholic
beverages at the police department and then wait for you to leave their
parking lot to pull you over? No, they are patrolling the public areas
of Fortville (including public parking lots). Public intoxication is when
a person is intoxicated in a place of public domain. The streets of
Fortville are public domain! Keep up the good work Officers!!!!
Thank you for all that you do for my family day in and day out even
when there are people out there that will criticize you for doing your
job.......... until they need you and then they want you to do your
