Tony, I faced foreclosure about a year ago. My taxes went up, and my homeowners insurance went from $900 to $2300. I had an adjustable rate mortgage and even though it only adjust 1%, it was hard to make the payment. When I couldn't make the payments I tried to call the bank. What I got was a "servicing company" for the bank who wouldn't negotiate, so I went to an attorney.

The first thing the attorney said to me was "The bank DOES NOT WANT YOUR HOUSE if you can afford to make reasonable payments" The bank CANNOT adjust your taxes or insurance.

After a year of going back and forth, the bank amazed me by putting me into a fixed rate loan at 4.75% without extending the term of my loan. My attorney and I were both amazed.

During the time that the banks servicing company would not accept payments, I used the money to become completely debt free except for the house. When I paid off all of my debts, I started banking the mortgage payments and was able to give the bank what they required, which was only $5000 for back payments.

IT IS POSSIBLE TO WORK WITH THE BANKS, unliess you are unwilling, or unable to pay for your house.

I'm glad that it worked out for you. Well for me I give up. I have been more than willing to try to reason with the bank. We paid a lawyer $1,000 to try to remodify our loan just for him to say.."Sorry, we can't do anything." The biggest problem I have is the fact that the mortgage holder is the evil COUNTRYWIDE MORTGAGE!!! I'm sure you heard the name? The same company that is mainly responsible for putting this entire country in the mortgage crisis that's it's in now!

I know who Countrywide Bank is. Your lawyer must not have been very persistant. BANKS DO NOT WANT THIS HUGE INVENTORY OF EMPTY HOUSES, they would prefer to work with homeowners.
