Bullitt Co. smoking ban ruled unconstitutional

Referring to the Bullitt County Health Department's attempt to impose a smoking ban as "Big Brother conduct," Bullitt Circuit Court ruled the ban unconstitutional Thursday.

An appeal would be useful, based on the clear lack of reasoning of the court. Anyone sitting judge whose insight fails so miserably as to permit this statement should be put out to pasture:

"The court disagreed, raising the possibility that the Health Department could as easily try to regulate how much sleep people should get or whether they should eat red meat or candy."

Which of those three items is an issue because of its effect on those around the person engaging activity? None of them. The entire statement shows either extremely limited reasoning ability or sufficient bias that the guy should have recused himself from the case.

Please note that it is not a smoking ban that was ruled unconstitutional, but only the source of the regulation. The representatives of the cities taking the health department to task were saying that was their job--and the health department rep is saying, "so do it, already."

I predict there will be enough people who support the idea of the regulation--and who were pleased and relieved at the prospect of its enacting--that taking it back from the will cause significant backlash and the communities will demand that those who claim the power to do it follow through for them.

That particular incarnation of it may be, depending on how hard the county health department wants to fight over it. Again, though, consider the premise for the suit. It was not "That isn't a good thing to do!" It was "HEY! That's OUR job!"

Watch and see if there aren't a huge number of constituents ragging on those legislators to get ON with it, now that they have so publicly asserted their authority to do so. Think maybe re-election is important enough that they might do something themselves?

I would bet the constituents did indeed let the fiscal court know that they are against the ban thus the lawsuit, we have seen expamples of those fraud polls for that 70+%

Here is a link to the actual ruling, so you don't have to work through the bias of any reporter. The bias of the judge we can't escape but, again, that's what appellate courts are for.
