Military Can't Be Sued For Malpractice

About a year ago, CBS News reported on the story of a Marine, Carmelo Rodriguez , who died of skin cancer that military doctors noticed but left untreated.

When a person joins the military they are risking their lives to protect our country. They think the risks are being killed by forces we are fighting. Not all military doctors are incompetent. The fact is a large number are! The Feres doctrine protects the incompetent ones. On the Army’s recruiting web site for doctors it even says you don’t have to worry about Malpractice suits. This must be the Military’s way of saying if you can’t cut it as a Doctor in the private sector join us and we’ll protect you.

My son Michael Fremer was killed at Fort Polk, La on 2/13/08 because of Army Negligence at the conclusion of a training exercise. The Army can not be held accountable because of the Feres Doctrine. This law needs to be changed. Why is the Army exempt from being held accountable for Negligence? Our young men and woman are risking their lives. This is how our country treats the soldiers and the families?

There are other cases that involve the feres Doctrine. For example Marines being exposed to Toxic chemicals on US Bases on US soil. The Military is exempt from being held accountable on all of these matters. The Feres Doctrine needs to be overturned. Take a look at the On-line feres doctrine petition. There are over 5000 signatures and a lot of horror stories of Medical Malpractice and Negligence.

i totally understand where your coming from. i do not mean any disrespect but you cannot blame the army for your son's death. It was exactly as you say, an accident. i agree that it was a horrible accident. But u say something about an "easy task of rengaging the parking brake" have you ever ridden in a duece-and-a-half? it's a large military vehicle. like i have sad before, this was a very sad ACCIDENT. the army should not be held accountable for someone else's actions. you dont blame the government for your wife being in a car accident? i just know that i am joing the Marine Corps and support anyone else that plans to do so. i do feel for you and your family.... i really do

Chock blocks were not being used. They are required as per the Army rules. The person that released the break by mistake claims she didn’t know how to re-break the truck. It is not difficult to re-break a truck that started to roll backwards. As you know every soldier is required to learn how to Fire a rifle. They are also required to learn how to drive a truck. This soldier claims she didn’t know how to drive the truck. She claims she was on mail duty when the class was taught on truck driving. It is in her written statement.

You made my point. In the private sector people are held accountable for their actions.
In the Army it is covered up or swept under the Rug. The Feres doctrine keeps the Army from being accountable. Plain and simple.

exactly, i understand that someone should be held accountable. The woman should be held accountable, not the entire army. But i recind my statement if the army is immpeeding the law and accountablity. If that is the case then you should have the right to take on the us army.

Because of the Feres Doctrine the Military is not held accountable for Medical Malpractice. They are not held accountable when Marines were exposed to Toxic Chemicals on bases that were on US soil. They knew Marines were being exposed to Chemicals that caused Cancer over a 30 year period. They just didn’t care. The Military is also not held accountable where there is gross carelessness and negligence during training exercises. The one place the Feres Doctrine is valid is on the battle field.
