Health and Human Services Secretary Kathleen Sebelius has conceded that the Class Act is unworkable, and so Blahous zeroes out those phantom savings.

Another reason Obamacare was supposed to save money is that it raises the Medicare tax 0.9 percent for high earners. It then dedicates those resources both to Medicare and to general revenues, with the CBO counting the savings twice.

Thatís because under a 1985 internal ruling (not a full-fledged law passed by Congress), the CBO scores the costs of legislation against a hypothetical baseline rather than against current law.

But, as Sebelius conceded to Congress in March 2011, thatís double counting. The government canít spend the same money twice. Medicare tax revenues dedicated to current Medicare spending canít be used to reduce the budget deficit. Thatís true ďin practice,Ē Medicare chief actuary Richard Foster wrote last year, despite the CBOís scoring procedure.

And, as Blahous points out, if the funds donít go to Medicare, then under current law, Medicare will go broke faster and be forced to reduce benefits.

And so when Charles Blahous totes up the numbers and give us an idea of what Obamacare would really cost, they are left without an intellectually serious reply.

If Obama really knew constitutional law, he might remember that the Supreme Court unanimously overturned the National Recovery Act in 1935, after it became clear that, with its 700-plus industry groups setting wages and prices, it was unworkable and was becoming increasingly unpopular.

Why Is Obamacare Unconstitutional Ė Three Reasons Why the Law Should Be Struck Down


Here are my answers to the question of why is Obamacare unconstitutional:



1) It forces citizens to buy coverage.

Some people elect not to purchase healthcare from their employer to save money, but they will have to have insurance under the new laws. Other people donít have insurance because they donít have a job. Proponents of the new healthcare laws argue that everyone should be able to get the care they need, but the fact is that no one can be refused care if they go to the emergency room.


If the citizens of the United States are forced to buy healthcare, then they can be forced to buy anything. The government could realistically force people to go to the dentist twice a year or change their oil every 3,000 miles if they can force Americans to buy health insurance. Having an individual mandate that requires consumers purchase health coverage provides lawmakers with a slippery slope to require other purchases from citizens too.




2) The country canít afford Obamacare: It's a Suicide pact

The costs of providing care to everyone will drastically increase the costs of healthcare. This has been well documented by several agencies. The Congressional Budget Office (CBO) now states the new law is actually going to cost $1.76 trillion dollars to implement. Originally they estimated it would cost $940 billion to implement, so this is a huge increase from the initial estimates of the bill. Even at a price tag of $940 billion, the costs associated with this bill threaten to devastate the American economy.




3) The government fails at running the post office, social programs and everything else.

One of the biggest issues I see is that the Government canít run the post office, social security, or the welfare system without massive waste and frivolous spending, so why would anyone want the government running the healthcare industry? The public schools of the USA are lagging behind many other countries, so why does anyone think that the government will do a better job of handing healthcare than the companies who have provided healthcare for over 100 years?




Why is Obamacare unconstitutional?

It's simply because the Federal government cannot issue a mandate that forces citizens to buy any product or service.

Justice Kennedy: Individual Mandate Fundamentally Changes Relationship Of Gov't



During the debate of the Obamacare mandate at the Supreme Court Justice Kennedy says that the mandate fundamentally changes the relationship of a citizen with the government.

CHIEF JUSTICE ROBERTS:
The key in Lochner is that we were talking about regulation of the States, right, and the States are not limited to enumerated powers. The Federal Government is. And it seems to me it's an entirely different question when you ask yourself whether or not there are going to be limits in the Federal power, as opposed to limits on the States, which was the issue in Lochner.

SOLICITOR GENERAL VERRILLI:
I agree, except, Mr. Chief Justice, that what the Court has said as I read the Court's cases is that the way in which you ensure that the Federal Government stays in its sphere and the sphere reserved for the States is protected is by policing the boundary: Is the national government regulating economic activity with a substantial effect on interstate commerce?

JUSTICE KENNEDY:
But the reason, the reason this is concerning, is because it requires the individual to do an affirmative act. In the law of torts our tradition, our law, has been that you don't have the duty to rescue someone if that person is in danger. The blind man is walking in front of a car and you do not have a duty to stop him absent some relation between you. And there is some severe moral criticisms of that rule, but that's generally the rule.

And here the government is saying that the Federal Government has a duty to tell the individual citizen that it must act, and that is different from what we have in previous cases and that changes the relationship of the Federal Government to the individual in the very fundamental way.

Just remember that when the GOP gets rid of Medicare. Just who do you think is going to insure the average 70 y/o? That's why Medicare was created in the first place, because without workplace insurance people couldn't afford to buy health insurance on their own. So people had no choice but to work until they died, or retire and die quickly.

That's the new GOP healtcare plan- "Get rich, or die quickly".

They say the Republicans will take away the old people's S S, or they tell the stupid poor they will take away their food stamps.
