I was e-mailed by the Engle trust administration. and they said that affidavits/declaration are not acceptable

WHAT DO YOU MEAN BY AFFIDAVITS AND DECLARATIONS? GIVE ME AN EXAMPLE OF WHAT IS not ACCEPTABLE.

When the Engle Trust Amd. affidavits and declarations are statements that are made about something and they want medical proof that was dated before November 1996 stateing that the person had been dignosed and had a history of smoking.

The website for questions is www.engletrustfund.com I called the engle trust fund. Pictures are acceptable, they have to be verified by a non-family member. What they mean by a history of smoking is pictures, medical records that say how long they have been smoking. You can sometimes contact the insurance company where they were insured, they always have a record of whether they smoked or not. You have to answer that question on any application for insurance, health, life etc. You can call the trust fund at anytime, the number is on the website.

I cant any medical records, they have all been destroyed after 7 years. I caled the insurance companies and hospitals and cancer centers, they all been destroyed. So HOW can I prove they smoked for 30 or 40 years. My parents both died of cancer. Them lawyers no the after 7 years we cant get what we need. thanks

I GOT MY RECORDS FROM HOSIPTAL AND IT HAD BEEN FROM 1994 FOR MY HUSBANDS WHO DIE IN 1995,MAYBE IF YOU WENT DIRECTLY TO HOSIPTAL BECAUSE THE RECORDS THAT I HAD TO WERE STORED WITH A COMPANY AND THEY SENT ME COPIES FROM THERE.IF YOU HAVE NOT REGISTER THEN IT IS TO LATE
BECAUSE THE DEADLINE TO REGISTER JUNE16,2008AND THEN YOU HAD UNTIL AUG.1,2008 TO HAVE PROOF TURN IN.GOOD LUCK!

Hi All I think what the original post by David Rice is somewhat correct in that most of U missed the Boat------Why now are You coming up with details that would have qualified you for the individual lawsuits that closed around January 10th ??

For two years Lawyers in Florida -heavily advertised the Engle case and only a little over 7000 folks filed suit ( or met the qualiofications ------now suddenly tens of thousands are filing for a fund that has the same category ??? were you all asleep ?

This statement for Harve Judge Miller stated that anyone that was a resident in the State of Florida before November 1996 and was dignosed with the problems that were claused by smoking cig.would have a right to apply for part of the fund.So if you or survivor of a smoker as long as they registered by June 16,2008 and sent proof by august 1,2008 would have a right to apply.

Ann You are absolutely correct but missed the point of the first commentator ( I think ) and myself

If you were to put up two items for a raffle say a new Lexus and a Go-Cart ----Would it make any sense for everyone to fill out the form for the Go-Cart , but the vast majority ignore the Lexus ????

the fund was actually only advertised to the public for a few months ----the lawsuits ( same criteria ) for over a year and only a fraction applied

Thats my only comment-- not meant to be offensive by any means just puzzled

I understand what you are trying to say the reason I did not pay attention to the first adds that you say were out because in 1994-1995 i was taking care of my husband who was dying of cancer then in 2000-2007 i took care of my mom who died of cancer so I kad other things on my mind like surgery chem.tem.,doctor appt.so one day a friend of mind told me about the fund so I register and was sent the claim form to feel out and I have done it without a Lawyer.So we will see what happens I located the paper work that was needed.

yes we have already registered,and i called all the hospitals,doctors,cancer treatment centers,insurance companys and funreal homes.......
they All SAY the records were destroyed after 7 years ,so now what do we do?

reply to lori this is true that by law they only have to keep records for so many years I do not know why the hos.in Ocala had there records stored and that is where a got the records from.Maybe you ask the hos. if they store there records the Quinlan Compaies,Inc.records management this is were the records that I needed came from.GOOD LUCK!

Lori,
I went to the doctor who treated my grandmother and he wrote a letter that he treated her for lung cancer do to the effects of smoking. We couldn't find any records what so ever. I called the Engle Trust Fund and they said that is acceptable. They also said that the death certificate will list a cause of death. Sometimes that is all you need if the cause of death is a diagnosis that can only be from smoking.

Your statement is not correct. My attorney said photos are a must if you could not provide medical records and or death certificate that has cause of death.
Also, they are 64,000 that have registered. Out of those, they will weed out those that don't meet the requirements ( was told about 15-20%).

i just read an artilce on law.com that 40,000 thousand had filed as claimants, but they expect up to 25 percent to not be able to document everything i have everything but proof of smoking history, came here looking for what type of proof i need, pictures are an idea i hadn't had, and will now look for too.

for those that are effected by hospitals not having medical records, some people effected might of filed for SS disability, if so those records would be proof. it might be hard to get them, but it helps to know someone inside SS

Thank yoGene what a heart-felt story,I would contact the Engle Trust Fund,also you can get all of his Medical Record's from the Doctor(Pulmonary),or Primary & go to hospital & go to medical records and get his medical history,This is a sure case of his illness(C.O.P.D.),AND ENTIRELY CAUSED BY SMOKING.
