Opponents of Indianapolis smoking ban to unite in court

Actually, it was most likely because their lawyers argued that "The court cannot determine which of our addicts would have been stupid enough to have smoked even without our illegal activity, so you can't make us pay for helping any of them".

I have found a way to slash the amount of money I speed on smokes. They are just about as good as store brought ones. I now spend about one dollar or so a PACK.

Freedom: you are absolutely correct. prohibition only creates a black market for any items that are outlawed. It is happeningin New York right now. They raised the taxes so much on cigerettes that their is now a black market and people are making a killer profit on underselling the state. Prohibition does not work for anyone but the black markets.

You must not have noticed. There has been a black market on cigs cfor a LOOOOOONNNGGGG time. The great thing about this is that whenever prices on cigs goes up in the store, the prices on cigs also goes up in the black market. There are also hundreds of websites that promise to sell you cigs at a discount. All you need to do is give them your credit card or bank information.Since they are OVERSEAS, they do not have to report your information to the authorities (however, there is not the same sort of freedom on the part of your credit card or bank- they can and do report tax scofflaws). Assuming you DO get smokes, the probability is good that they are made in China (trust the Chinese to make a SAFE product for consumption). Of course, you may also get ripped off. That happens a lot when you are trying to skirt the law.

Basically, no matter where you get your smokes- legitimate sources or black market profiteers, if tobacco taxes are raised, your costs will increase.

That black market depends on the ability to hide itself in the other market, though. The logistics of getting away with any significant (in terms of the industry involved) marketing and consumption of tobacco products without the legal trade to disguise it would quash it pretty quickly. It may be difficult to tell illegal smokes from legal smokes, but there is no problem distinguishing illegal smokes from NO smokes.
