It is a case of DHS agents who did not do their job and it continued until Carolyn Singleton, the Adult Protective Services Administrator left her job and possibly to this day. I note a specific case in which Carolyn Singleton did not do her job. In fact Carolyn Singleton supervised the Arkansas Long Term Care Ombudsman, Kathy Gately who was responsible for ensuring that the rights of the elderly and sick were not violated who lived in LTC and assisted living facilities in Arkansas. She was to be an advocate for these vulnerable residents. She did not appear to take that responsibility seriously in one case. A 75 year old man, a retired minister, Robert Franke decided to move to Arkansas to be close to his daughter and moved into the Parkstone Living Center in North Little Rock in 2009. After learning the next day that Mr. Franke was HIV positive, he was evicted from the facility in violation of federal and state law. Not only was he evicted, the administrator threatened Mr. Franke's daughter. THE ADMINISTRATOR TOLD MR. FRANKE'S DAUGHTER THAT HE WOULD BE TURNED OVER TO ADULT PROTECTIVE SERVICES IF WAS NOT OUT OF FOX RIDGE BY THE END OF THE DAY. There you go. Ms. Singleton headed an agency that received millions in Federal Funding with strings attached, especially in regard to discrimination. Ms. Singleton was charged with protecting this man's civil rights but failed to do so. Furthermore, the drive from Ms. Singleton's residence to Fox Ridge is approximately 5.6 miles or 11 minutes. It is a shame that Ms. Singleton could not work that into her schedule. Since then this man has sued and settled with the facility with NO help from Carolyn Singleton and ironically Carolyn Singleton's brother was among the first to die from AIDS related conditions. I have no doubt that he would be ashamed. You are exactly right, this is about government officials making thousands of dollars a year, who did not do their job. It is not really about incompetence, but more about a lack of willingness to do the right thing. The state long term care ombudsman supervised by Carolyn Singleton, Kathy Gately, remains in her position to the best of knowledge, even after such a heinous lapse in responsibility and judgement. You are right. What I am pointing out is there are different standards applied nursing homes in much of the state compared to standards applied to individuals as individuals do not have a lobbyist. I applaud Larry Jegley, the Pulaski County Prosecutor who was instrumental in getting laws passed to ensure better care and who has also prosecuted facilities who failed to provide proper care. In other parts of the state prosecutors are not so concerned with nursing home abuse and neglect.
