Does anyone know about the medicare payments or liens if I pay for medicare insurance also a private insurance why would you have to repay medicare? I don't know for sure if I would owe anything with the settlement..If anyone has already received settlement and had medicare that you pay monthly premiums for please respond and let me know if the w/holding anything for reimbursement for medicare...it does not make sense because I don't have to pay my private insurance back...you never know...this whole thing does not make sense.

Carrie it is so hard trying to shift through all the post to see what fits all because your attorneys don't or won't tell you anything, but i'm sure the attorneys won't have any problems collecting their 35%.. I haven't gotten an award letter as of yet, but hope to in a couple of months. Has anyone with the Mullingan firm received a settlement yet?

A federal judge in New York has found that Eli Lilly and Co. has made excessive claims about its top-selling drug, the antipsychotic Zyprexa, and is urging the Indianapolis drugmaker to negotiate a worldwide settlement with plaintiffs, according to Bloomberg News.

U.S. District Judge Jack Weinstein also found enough evidence of fraud by Lilly to warrant a jury trial, the news service reported.

In a draft order filed today in federal court in Brooklyn, N.Y., Weinstein said he found "reliable information" that Lilly made excessive claims about Zyprexa's usefulness, and recommended off-label uses for such conditions as panic and anxiety disorder, agitation and dementia, Bloomberg said.

Zyprexa is approved for schizophrenia and bipolar disorder.

"A global settlement for the overpricing claims and any other claims is desirable," Judge Weinstein wrote, according to Bloomberg. He added that plaintiffs are seeking between $4 billion and $7.7. billion in damages, or about 25 percent of the amount they spent on Zyprexa since 1996.

Plaintiffs include patients and insurance companies.

Lilly spokeswoman Tarra Ryker said today the company's attorneys are still reviewing the judge's order, which is nearly 300 pages long. She said Weinstein's writings are not a final order, but a "discussion draft" that all parties can respond to. A hearing is set for July 17 in New York for responses.

In March, Lilly settled with the state of Alaska, which had filed a $270 million suit against Lilly in 2006, claiming the company withheld data on side effects, which included symptoms of diabetes, such as increased blood-sugar levels and weight gain.

The settlement in Alaska called for Lilly to pay $15 million to that state, along with an open-ended agreement to ensure Alaska is "treated as favorably as any other state" that Lilly might settle with over similar claims in the future. The agreement involved no admission of wrongdoing on Lilly's part. Nine other states have filed similar lawsuits against Lilly.

Lilly has paid more than $1 billion in recent years to settle claims from 25,000-plus patients who accused it of underplaying side effects, including weight gain and elevated blood sugar.

The company acknowledged it has received a grand jury subpoena from the U.S. attorney for the Eastern District of Pennsylvania, seeking documents related to Zyprexa. Lilly said it has provided a broad range of documents and information to investigators.

slim chance....but "u" should be entitled to money from leftover EIF funds..which to date the first 2 groups (8000 OR 2700)have recieved nothing to my knowledge. That money is laying in the bank drawing interest for the special masters..

INDIANAPOLIS (AP)— A federal judge in New York is urging Eli Lilly and Co. to settle a multibillion-dollar lawsuit filed by insurance companies, unions and others who claim the pharmaceutical giant overpriced its top-selling drug Zyprexa and exaggerated its usefulness.

In a 290-page discussion draft, U.S. District Judge Jack Weinstein said he was prepared to grant class-action status for the lawsuit brought by Mid-West National Life Insurance Co. of Tennessee and others. He set a hearing on the proposed order for July 31.

Weinstein made it clear he believed there was enough evidence for the case to proceed to trial, and urged a settlement. Weinstein's draft cites two experts' estimates of damages, one of $4.9 billion and the other ranging from $3.9 billion to nearly $7.7 billion.

"A global settlement for the overpricing claims and any other claims is desirable," he wrote. "Legal disputes of this nature should be resolved as quickly and comprehensively as possible so that government, the medical profession, and drug manufacturers can get on with their main job — protecting the people's health effectively at the cheapest practicable cost."

The claims center on alleged overpricing and allegations that Indianapolis-based Lilly marketed the anti-psychotic drug for unapproved off-label uses.

"There is evidence that off-label use of Zyprexa was excessive and may have been encouraged by Lilly," Weinstein wrote in the draft filed Wednesday.

Lilly spokeswoman Tarra Ryker on Thursday denied that Lilly pushed Zyprexa for uses other than prescribed.

"Lilly does not promote off-label,... but doctors do prescribe all kinds of medications off label," she said.

The plaintiffs claim Lilly violated the Racketeer Influenced and Corrupt Organizations Act through mail fraud, and Weinstein said there was enough evidence to take the claims to trial at which jurors would determine the excess pricing. The plaintiffs also claim Lilly disavowed secondary effects of the drug, including diabetes and weight gain.

"At this point there's no evidence that any plaintiffs have been harmed by the drug," Ryker said.

Ryker said Lilly attorneys still were reviewing details of the lengthy draft. She emphasized that the document was not a final ruling. "I think the main thing is that this is not an order, this is a discussion draft."

In March, Lilly and the state of Alaska announced a $15 million settlement in a lawsuit over the use of Zyprexa in the state's Medicaid program. Several other states have also sued the drugmaker.

Zyprexa brought in $4.8 billion in sales last year, accounting for 25 percent of the company's total sales. But Lilly also has faced layers of litigation over the drug. Besides the state cases, the company has spent more than $1 billion to settle product liability claims from patients over Zyprexa, and about 1,200 cases were still pending earlier this year.

Zyprexa is being avoided by doctors they aren't prescribing it for new patients anymore.
Zyprexa has generated a lot of bad press for EliLilly and they still have unresolved Zyprexa settlement claims.
Eli Lilly is 'reaping the whirlwind' for aggressive marketing of Zyprexa that has caused suffering and deaths.
Abilify is now the most popular anti-psychotic favored among psychiatrist. What the managers at Eli Lilly should consider is how Zyprexa is being avoided by doctors they aren't prescribing it for new patients at all anymore.

i emailed watts about the eif fund but yet to get a reply. i am still upset that watts said that the 33-35% rule doesnt apply to them. i am at the point that i am going to send all of my papers to the judge and let him see it. i believe that i am still due several thousand dollars just because of the difference from the 40% the attorney took. which was 40%. the lawyer doesn't seem to understand the diffence between mentally ill and mentally retarded. i believe that we are going to have to show them! if you here any thing let me know.

no news from my end...."To Get Attention" u need to write the judge..the judge will turn ur letter over to the special masters who in turn will send it to the lawyers... letters sent to the judge are not ignored...
