Has anyone been paid yet?
If you've read the media reports judge weinstein demanded this past summer that the law firms not drag this out and had them submit all their cases so that payments to claimants could be started as of august 1st. I found this on the net and i found it obtuse in all reasoning http://lawprofessors.typepad.com/mass_tort_li...

Zyprexa Settlement Approved
Article from Sept. 28 by Jeff Swiatek of The Indianapolis Star --$700M Zyprexa Deal OK'd by Judge:
(quote)
Notably, the Zyprexa deal is a mass aggregate settlement of about 8000 individual claims in the MDL, rather than a class action settlement. Although it's not a class action and therefore not governed by the judicial approval requirement of Rule 23(e), Judge Weinstein took the unusual step of reviewing the settlement, and also capped attorneys' fees. Another interesting aspect of the deal, according to the Indianapolis Star article, is that it includes a reimbursement plan for Medicare's and Medicaid's share of the settlement funds.

the lawyers fees have been capped at 35% in case anyones wondering. My law firm keeps giving me this "i dont know " crap. Why dont they know? rumorville says the firms have been waiting for this 'company or other law firm' to send them notifications of who to pay and when. dunno if theres any truth to this. indeed they are paying claims according to how much...ex if someones collecting 5k then those will be paid first...and so on up to the highest.

Id just like to know if anyones been paid at all. please post replies here.

I think people are starting to finally get paid. I am scheduled to recieve payment in a couple of weeks. I understand that it is VERY frustrating waiting for the checks, but just think for a minute just how fast this whole settlement case has gone in comparison to other cases like this one. Frankly, it's a miracle. All of our attorneys are working very hard. Plus good things come to those who wait.

Sincerely,
A victim of this injury at age 17 who has the rest of her life to deal with this disease and all of the now lost opportunites such as having a family.

And oh yeah...our attorneys don't get paid until we get paid. And trust me they want to get paid as much as we do :-)

Has anyone using Douglas and London, NYC, been paid? If so, would greatly appreciate hearing from you.

There was someone on the other Forum (Zyrexa) who has them also and she did get paid (named Steph). It was a while back so check some of the earlier posts. I think it was around Nov. I haven't seen her post for a while. Most of the people kind of drop off after they get paid. I don't blame them I probally wont stick around too long either. Maybe just check in every now and then.

I was surprised to receive a return call yesterday from D&L. Told I should expect a check in two weeks, give or take. I'm afraid to get my hopes up as I was told the same thing in November, w/o further explanation when it did not come. I believe there is a definite element of guessing on the part of D&L for they have processed my claim, it's no longer in their hands, and there is little anyone can do but wait. Since I will have a Medicare lien, that may be the reason for the delay; I'm in the #4 group. To alay my fear of not even getting a check, was told that was not the case. I am not well because of Diabetes-related complications and the stress of waiting is taking its tole on me, both mentally and physically. There should have been more written communication on the part of D&L to explain the delays. I will be back to report when it's received.

The waiting is agonizing. I feel like the attorneys tell me what they think I want to hear and give me false hope about possible payments. "It might be next week." and still not here three weeks later. I do much better with the truth. I am working with Seeger and Weiss in NY...anyone having better luck?

They already have been paid your full amount. You should not be waiting for anything. I think someone wants a little more interest off your money. That makes no sense unless the lawyer needs some extra vacation money.

I have seriously thought of sueing the doctor. He knew after September,2004 the side effects of zyprexa. He should have taken me off of it. Both, my doctor and Lily, are to blame for this. My doctor never monitored my blood sugar levels. It is so wrong.

I have read on these posts, the settlements are only giving people a small amount of money for their diabetes(although I really don't know how much). Well, if it is true, this is wrong. How much is their lives worth? May the Lord have mercy.
