1 In the contract that was signed in POEA, the salary is 520 dollars. Then these agencies cut the salary off to 300 dollars each laborer. Imagine how much money are these....These agencies have charge each laborer of more than 400 Dollars as their placement fee PLUS the 220 dollars cut from the salary of each SUFFERING laborer in CIFEX WORLD each month PLUS the CIFEX WORLD payment for each agency. Then each of them paid for their medical examination and before departure each of them asked to pay almost 10 dollars each for “UNIFORMS”...my gosh, can you imagine these things! Hey what are you doing!!!! You didn't know how much or what these people have sacrificed to be able to try to venture to other country because of poverty in the Philippines. What kind of people are you!!!!! These agencies didn't pay much for anything because the company, CIFEX WORLD Libya Branch with SLIM RIAHI the chairman and Director of this so called company paid everything ( Medical Examination, Visa and these agencies). UNIFORMS are FREE according to CIFEX WORLD. Now the company, CIFEX WORLD, TRIPOLI LIBYA IS “EXPLOITING “ less than 500 FILIPINO WORKERS there. They are requiring the the laborers to do the job that is not stated in the contract they have signed. CIFEX WORLD, TRIPOLI LIBYA is requiring them to work 7 DAYS a WEEK, 12 HOURS a day with UNPAID OVERTIME and HOLIDAYS and the 7th day work is also UNPAID. What can you say about this? These laborers that had ventured in this kind of company trusted the so called “contract” and the so called “ agencies”... Now they are ALL ALONE SOLVING THEIR PROBLEMS THERE with the Philippine Embassy. WHAT ARE THE AGENCIES DOING NOW????? That's a very BIG QUESTION???? Imagine how much money are in your hands now, from almost less than 500 laborers who are suffering there right now...No wonder you can sleep!!!!! Is anybody out there who can help us with this problem.... WE ARE PLEADING LIBYA GOVERNMENT TO HELP US WITH THIS MAJOR PROBLEM!!!!! |

POEA Suspends Firms for Violating Contractual Obligations of Filipino Workers in Libya
April 16, 2009 by DFA-PISU PR-194-09, 16 April 2009 - The Philippine Overseas Employment Agency (POEA) has already suspended Aqua-Gem International Manpower Corporation, Sharikat Al-Saedi International Manpower, Inc., and Cifex World Libyan Branch from participating in the overseas employment program of the Philippine Government. POEA found strong evidence that Aqua-Gem and Sharikat Al-Saedi committed misrepresentation and contract substitution, while Cifex defaulted on its contractual obligations and committed grave misconduct. Only six of the 271 Filipinos employed by Cifex were sent back to the Philippines last April 2. The Philippine Embassy in Tripoli, through the Office of the Labor Attache, is closely coordinating with these companies to ensure the protection of the Filipino workers’ rights and welfare. Contrary to earlier reports, Labor Attache Nasser Mustafa and Welfare Officer Robert Baccig did not drag their feet on the alleged abusive practices. It was the interventions and the reports of Labor Attache Mustafa, dated 12 and 22 February, that largely served as the basis for the suspension imposed by the POEA on the three companies. Official urges OFWs to report contract substitution at once
By Joe Avancena AL-KHOBAR - Victims of contract substitution are urged to file charges immediately against the employers and the recruiting agencies that deployed them, the chief prosecution officer of the Philippine Overseas Employment Administration (POEA) said. “A victim of contract substitution, or misrepresentation, must execute a sworn statement that he had been victimized and approach the nearest Philippine Overseas Labor Office (POLO) or Philippine Embassy to file his case and seek assistance,” said Jovencio R. Abara, POEA chief prosecuting officer. “OFWs who are victims of this rampant violation of contract are encouraged to seek assistance right away in order to prevent serious and grave consequences of the misrepresentation,” Abara told Saudi Gazette in a telephone interview. Contract substitution occurs when the original work contract is substituted by a new contract with lower salary rates and lesser incentives. The substitution usually takes place at the airport when the workers are about to leave or upon arrival at the job site, Abara noted. “This misrepresentation in contract is a major problem encountered by our workers; we would like to minimize it, if not completely eradicate this,” Abara said. The latest case of contract substitution involved 19 Filipino workers deployed to Tripoli, Libya by Aqua-Gem International Manpower Corporation and Sharikat Al Saedi International Manpower. They were hired to work in a government project carried out by the Libyan company Cifex World Libya. The workers filed their complain of contract substitution and misrepresentation at the POLO, Philippine Embassy in Tripoli. In their complaint, they said they were forced to sign the second contract on the date of their departure. They were forced to sign the contract which stipulated lower salaries because they have already incurred large sum of money in applying for the job. The workers also complained of delayed in salaries, excessive working hours, non-payment of salaries, maltreatment at the jobsite, insufficient food and unsuitable drinking water, absence of emergency medical services, and no laundry services. Nasser S. Mustafa, labor attaché at the POLOin Tripoli filed two separate reports to POEA on Feb. 12 and to the Secretary of Labor March 25. POEA administrator Jennifer J. Manalili ordered last April 3 banned the employer, Cifex World Libyan, from taking workers in the Philippines and suspended the licenses of its recruiting agencies, Aqua-Gem International Manpower Corporation and Sharikat A-Saedi International Manpower. Sanctions urged vs labor recruiters to Libya By Jerome Aning Philippine Daily Inquirer First Posted 08:08:00 04/06/2009 Filed Under: Overseas Employment, Labor MANILA, Philippines—Two Manila-based recruitment agencies have been recommended for blacklisting and suspension for allegedly pulling a switch on the contracts of 300 overseas Filipino workers they sent to Libya last year. Philippine labor attaché to Libya Nasser Mustafa recommended the blacklisting of Sharikat al-Saedi International Manpower Inc. and Aqua-gem Manpower Corp. to Labor Secretary Marianito Roque. Roque chairs the governing board of the Philippine Overseas Employment Administration (POEA). “Libyan employers prefer to hire Filipino workers but if violations like this go unpunished, it would discourage OFWs from going to Libya. So I recommended that we stop the deployment of OFWs through these two agencies,” Mustafa told the Philippine Daily Inquirer in a phone interview. Mustafa, who heads the Philippine Overseas Labor Office (POLO) in Libya, had learned that the contracts of 289 OFWs hired by Cifex-World construction firm through Sharikat and Aqua-gem were replaced with new ones as the OFWs were about to board their flight to Libya. The attaché, who was in Manila over the weekend to pursue the case against the recruiters denied accusations by Migrante-Middle East that he had neglected the Cifex workers. The migrant group had earlier called on Roque to recall Mustafa and welfare officer Robert Baccig for purportedly defending Cifex during a dialogue held on March 28 between the OFWs and their employers. The OFW group Migrante-Middle East, which is helping the OFWs, reported Sunday that while Mustafa was in Manila, a representative of Sharikat arrived in Libya and accosted the complaining OFWs. Four OFWs—Ruel Ramos, Robert Tulop, Nestor Rivera and Henry Torres—were ordered terminated when they refused to sign new contracts, according to Saudi Arabia-based Migrante-Middle East regional coordinator John Leonard Monterona. The OFWs, both skilled and unskilled, were hired for the construction of a seven-story palace complex for visiting foreign dignitaries. Libyan President Moammar Gaddafi wanted the project to be completed within the year, according to Mustafa. After they arrived in Libya, the OFWs told POLO about the contract substitution, which resulted, among others, in the reduction of their basic salaries from about $500 a month to $300-$400 monthly. They also complained of poor living conditions, saying the meals served them were insufficient and the locks to their quarters had been removed, violating their privacy. |
