Tow truck drivers are considered thieves until proven innocent so they assume that risk. There should not be an arrest in this case.

i have no pity for tow truck drivers, most are vermin. they act as if they are the police, but they have no authority at all. the trick is to shoot them, before the reach for their gun. bang bang.

If it was a city contracted tow involving a city employee, then this is very sad. If it is a shady towing company trying to take advantage of people, then the driver may have deserved it. Many tow truck drivers break multiple laws, and companies charge illegal fines to regain your property.

Simple logic! If the sign says, "No Parking" then don't park there! If the violator's auto is towed, he should just pay the fine. Some people can only learn through their pocket book! Where is the logic to try to kill the tow truck driver because you cannot be a reponsible citizen and voluntarily obey a sign? Why blame the tow truck driver if violator cannot be responsible for his actions? Now the violator will probably receive a prison sentence which will cost the taxpayer! Wouldn't it have been easier for the violator to just obey the sign? Voluntary compliance with the law is the basis of a democracy! Think about this!!!!!!

I agree, don't park in the wrong areas and you don't have to even worry about this. I will say this though, i know of a couple of wrecker services and most of them employ outlaws and ex criminals.

While I don't condone violence to solve the situation, I still stand by my statement about needing more information. Many area towing companies are known for towing in areas that are not clearly marked (especially apartment complexes). As far as compliance with the law is concerned, this is an entirely private/civil matter. Police departments will issue parking citaitons for illegally parked vehicles, and will tow vehicles that pose a threat or danger to the public. Private towing companies enforce "rules", not laws, and take no actual legal actions. The police will cite you for parking in a fire lane, but they will never tow your car if it is left in a "resident parking only" spot. I am 99-100% sure that there was some sort of argument or discussion prior to the shooting that offered the driver ample time to call police to settle the dispute. However, police often require that the driver prove that he is in fact contracted and is complying with city codes and most drivers do not want to involve police. The driver is not a cop and needs to realize that he always has the option of not towing a car if it is dangerous, rather than engaging in an argument with a possibly insane stranger.

I used to own a towing company. It was a small operation, but one none the less. We did repos for private car lots. We also did tows for mechanic shops. And never have we had an incident like this. I agree, some companies have this "control complex", much like cops and security guards. But it never seems to amaze me, people will rather blame the wreckers, than pay their car note, or park in the correct spot.

I was curious and did some research. This actually happened in June of 2007. According to the Mesquite news, police learned that the tow truck driver has a concealed handgun permit. A police investigation (as of 06/2007) showed that the tow truck driver actually fired first. There is clearly much more to this story. Like I said, I do not condone shooting a father who is trying to do his job and support his family over this type of argument. However, there is a degree of responsiblity that all tow truck drivers/ repo men/ collection agents must assume when they attempt to deprive someone of their property. Police are paid and trained to enforce the laws and can handle situations when they turn violent. Private citizens who are employed by collection oriented businesses need to know when the risk has outweighed any possible good that can come from a situation and just walk away.

I have had experience with tow truck drivers in the past, primarily with overly vigilant tow truck drivers towing cars away form apartments, townhomes, etc. Often times they will just hook up the primary equipment that is needed to tow the vehicle out of the immediate area, then they continue to completely hook up the car so it can be towed to the impound lot, despite the fact that this illegal. If someone hears the tow truck driver outside hooking up their car to tow it, you have the right to prove that it is your car and you in fact to live at the location. They do this temporary hook up so that you don't have the chance to do so.

There are SO many crooked towing companies. Once my car was towed at my apt complex only because I backed into my spot...they cruised the lot and decided they didn't like that. Anyhoo I got my car back after I hollered at the apt manager and guess what....they put my car back in the way it was...backed in. LOL

Good to hear that the driver is most likely to recover, but goes to show tow truck drives how angry a person gets when their car is towed away.

Is it just me or is shooting someone over a car stupid. A car is just a thing you bought. And a person cannot be replaced. Now I'm not saying you don't have a right to protect your life if they open my front door I am running for my gun but a car they give those away almost.....

MORONS! If you fail to make payments on YOUR car, it is NO LONGER your car!! You have no rights to defend something that is not yours. Freaking RETARDS! And that goes for you uppity people who think you hve the right to park anywhere you like because your too lazy to walk a 1/2 block. If the sign says no parking, then don't park. If you do, your car is not being stolen, it is being removed. What was stolen was the parking you chose to take.

These wrecker thieves lurk in corners of dark parking lots, and tow cars from apartment comlexes all over the city. If you live in an apartment, and have a visitor, God forbid you should park in the wrong spot. The city has passed laws that allow a fair price to tow a vehicle, like $125, but that isn;t good enough, they add $another $125 as an "Unhook" fee. These wreckers are just another thief like the Nigerian scamers. Someone wanting money without work. that is my story. I am sure there are many much worse.
