Riparian rights should take precedence over local, state and federal laws. While Alabama Power might own the land "under" Lay Lake, and 398' above, the utility does not own the water that flows into and through Lay Lake. The water supply that borders the surrounding areas of Harpersville is actually a section of the Coosa River that connects Logan Martin Lake to Lay Lake. Does Alabama Power own this stretch of land below the Coosa River as well? If so, and considering its claim to own the land "under" Lay Lake, a question should be posed as to whether Alabama Power is paying sufficient property taxes on the "land" that it owns "under" some of Alabama's waterways.
If the utility feels compelled to do anything, maybe they could come to terms with Shelby County Sod to reasonably ration usage of the Coosa River water during the water shortage. When nature resumes its "natural" water distribution, then Mr. Winford's usage of the water should not be a factor.
Last but not least, Michael Snajderman should comment only on things that he knows about. His comments sound like repeated opinions, at best.
