Attorneys for John Henry Horton want testimony barred in his second murder trial
Defense attorneys preparing for John Henry Horton's second murder trial want a judge to bar testimony about hair that purportedly matched that of 13-year-old Lizabeth Wilson.
Public defenders Michael McCulloch and Carol Cline also contend that a search of the trunk of Horton's car the day after Lizabeth disappeared was illegal. They say a jury should hear nothing about the bottles of chloroform or other items found inside.
Meanwhile, the question of whether testimony should be allowed from one of the state's key witnesses is coming up again in a motion filed by Johnson County District Attorney Phill Kline. The Kansas Supreme Court struck down Horton's 2004 murder conviction, saying that that testimony was improper. Read more
