If the so called "beach owner" want to push the subject then let them pay back all the monies it took to sand that beach and to maintain it for 40 + years. Let them pay back taxes and let them take care of their own stuff... As a life long resident of this fair city and of the east beach area where I played as a child, I want that money to be paid back so it can go to other things. Mayor start putting those bills together!!!

Ya, look at it this way.
You own where your mailbox is, right? But maybe you let people walk by it on a sidewalk or the road. The city comes by & says, we want to put some flowers around your mailbox and you say OK. The city did do this for merchants downtown, gave them free flowers on their property. Should those businesses give that land to the city now?
But wait, the city decides that those little black lawn jockeys look really cool!(Like the Victorian lamps that look stupid here, we're not a Victorian town) And they want to put one by your mailbox! But you would be put to shame to have one of those painted things in your yard.
So you say no. East beach is no different. They did not want what the city wanted it to look like, not to keep people from using the beach. That populist crap of "now we own it, you go away" was just propaganda in my humble opinion. Shame on the city for spreading that around.

^glad someone has some logic. os observer must have missed the part where the beach was available for and has been used by the public for those 40+ years. os observer should also learn a little more about taxes. The county provided the beach services, why on earth would the mayor start putting bills together? Flawed logic. Try again

I have used the beach myself for over 40 years and will continue to do so no matter who thinks thay own the beach... I am a tax payer and come from a long line of OS tax payers and consider this beach to be PUBLIC!!! FYI-you pay city, county, state and federal taxes every day in some way shape or form...so guess what...the public is paying for it even if its the County who foots the bill...get over yourself and you learn more about taxes

^I understand taxes sugarplum. Just curious as to why you thought the city would be entitled to backpayments for upkeep. To be honest our city doesnt need anymore money. They are constantly creating new ways/projects to spend. Heaven forbid the city save money incase we should ever have budgeting concerns. perhaps they could learn from the city of biloxi's mistakes.

OS observer, why do you think those beach owners will deny the public the right to use the beach? I saw one on WLOX and he said that was never suggested or enforced. They just didn't want it to look like Front beach. Have you seen it lately? Where sand used to be there is now a dirt soup that no one would ever spread a towel on. I also predict that the remaining sand will wash out and the water will be all up to that "seatwall". It was designed by people who never spent their lives by a beach like that. Mother nature will not clean that beach up, ever; she will trash it with the next storm.

I don't want to landscape East beach either... but I still believe it is a public beach and not privately owned. Front beach may look better for a while but we all know what will happen after a strong storm. What is with putting trees on the Beach and pine trees at that...They placed them right where people like to fly kites...not anymore. Why the landscaping any why?

Actually the "beach owners" have not yet won their suit. The court ruled that they were entitled to their day in court. The ruling was essentially that the Secretary of State had arbitrarily determined them to not be the owners without giving them a chance to be heard -- a constitutional due process violation. Now the Secretary of State must prove in court his claim that the land is public to the seawall.
