Judge Walsh should be ashamed and disgusted with himself, as I am. Those who have the nerve to place blame on a dead man and his family are truly sick. May God help you. To shoot a man in the back as he walked to his home is cowardly, and no where near justifiable as self defense. I'm not sure who knows who and who owes who favors, but this type of gross injustice is unbelievable.

Maybe now Andy will be held responsible for his actions, since this was never brought forth in the first trial. Everyone wants Chad to be held responsible, but why not Andy. Why should he be allowed to go on someone elses property, make threats, destroy property and its suppose to be ok, because its Andy Buttermore...apparently he has done this on several occasions and "other" people were too afraid to come forward...well not anymore!

If the law is as Judge Walsh stated in his ruling--I am sure it is--why could this not have been determined long before Chad was imprisoned, denied of any means of supporting his family, subjected to character assassination, subjected to months and months of stress and the right to pursue a normal life? It seems to me that the justice system failed miserably and allowed itself to exploited to whitewash the "victim's" reputation and defame the true victim.

MAYBE this time a concessional jury will really LISTEN to the TRUTH and also put themselves into the shoes of the defendant and understand JUST WHAT the LAW requires and actually says about defending yourself and family.

Good luck Chad, you have a lot of supporters. If you come in my yard... physically fight with me, terrorize me and my kids, come back with a weapon, continue after my family is retreated in MY house, and break my living room window beside My front door... I WILL THINK YOU INTEND TO COME IN, BE AFAID OF YOUR ACTIONS AND WILL DO WHATEVER I FEEL THE NEED TOO, PROTECTING MYSELF FROM YOUR RAGE ! (and if you think a baseball bat is not a weapon try being on the receiving end of one) It is a very sad situation... Andy should have stayed home.

Do you "really" know anything about the case? If you did, you would know that Judge Walsh sentenced Kirby to 6 years - the time requested by DA Fogal. Judge Walsh had NO bias in this case. His decision was based on the LAW - nothing more, nothing less. Really.

Sounds to me that Judge Walsh did the right thing. Mr. Kirby wasn't given a "FAIR" trail and his attorney didn't even do his job correct. If he was a county public defender I would hope the county didn't pay him cause it seems for this story that he didn't do his job at all. Yes two wrongs don't make a right but Mr. Kirby has the right to a fair trial and he wasn't given that right and now has had to pay the price by having his name and his families name dragged through the mud and has had to lose time with his family by being falsely incarcirated in a state prison.
