Arditti trial defense lawyers, prosecutor fined

Bar complaints are supposed to be confidential- the judge should not be making this public.

Often after the passion of a case dies down, the contempt fines go away.

I still believe in term limits for judges as they forget what its like to practice law.

I've known Leeds for many years- he has a mouth- good for him!

I'm sure that Judge Smith has no idea what he has coming. He was a tyrannical lackey for the prosecution who probably only fined Kyle Lasley because he was disappointed that the State lost even with all the help the Judge was giving it. Stuart and Theresa are not afraid of public trials, and if the State Bar of Texas, which doesn't seem to do anything about prosecutorial misconduct or judicial misconduct, wants to fight them, I'm sure that Stuart and Theresa will fight it all the way to a public trial, at which time the State Bar of Texas itself will be put on trial for not doing anything about misconduct by public officials such as Jaime Esparza, whose office once again violated its duty to turn over exculpatory information to the defense, and Judge Smith, who chose to look the other way when the State's violation of Brady, or of its duty to turn over exculpatory information, became obvious. That breach of Brady should have merited a much larger fine than $20.00.

The only reason Aditti won was because she had two very good attorneys that did not take the bullying from the stupid,"east Texas judge" and the prosecuting attorneys. The only crime commited in court was the judge impersonating a pig. Stay in East Texas!

Now that this trial is over, what I want to know, is who is the DA going after now? The thing is, that Esparza does very selective prosecutions. I think we should all insist that he prosecute Attorney Biagas, who lied to the Feds and gave Judge Barraza a kickback on a referral. There were many witnesses who heard Mr Biagas confess to these charges at the Arditti trial. Come on Esparza, this one should be a breeze, especially since Teresa and Stuart already got him to confess to everything. I think that maybe, even you might be able to win this one. If you don't feel confident in doing so, you may want to ask Teresa or Stuart for help.
Jaime you need to start realizing that your days in the DA's office are numbered. If you don't get kicked out of office, you will be beaten next time you run. You yourself should have been prosecuted some years back for covering up what a relative of yours was doing. Unfortunately, the investigators in immigration were told to lay off your case, by someone in a high position. This should have been a big federal case, because giving out birth certificates to kids who were born and registered as Mexican citizens should have been a big time crime. You know that one of the investigators under D A Simmons, left the case in the D A office for you to investigate, since it was time for Simmons to leave office. But you never moved on it. Then, that truth came out, it turned out to be your first cousin giving out the certificates. I know many more thing about you, but I think I will save them and let them out, one at a time. You will find out that I will be the thorn on ykur side.

If the Judge was planning on giving out fines all along for contempt of court, why didn't he just grant the defense's numerous motions for a mistrial?

The good citizens of El Paso are sick and tired of the freak called Theresa Caballero and her public displays of unprofessional and inappropriate behavior. At last she displayed this in front of someone who had the power to do something about it, to put her in her place.

All the comments of support for her all over this forum are coming from the same two people. They think they can load up this forum and make it look like she has lots of support but they are fooling no one. The people have spoken (when she ran for office and lost) and now another judge has spoken. Time for her to look in the mirror and realize that it is not everyone else, it is she who is wrong.

The last time she ran Theresa won the support of Average Citizens in all parts of El Paso County except for the Westside where the citizens aren't average. Today the 12 El Pasoans who mattered spoke - they didn't find her unprofessional or inappropriate - they found her in the right. It shows she is a person of true character to not allow herself or her client be bullied by a closet Klansman who expects attorneys to sacrifice their clients like sheep in the interest of "decorum."

The Judges in el paso dont hold defense lawyers like Caballero to the standards of most American Courts because those judges need the $ those lawyers donate to their campaigns. It is a fact and although it isnt illegal it is unethical. Caballero is a good lawyer but is as unprofessional as they come and her theatrics belong in movies and not in a respectable courtroom. She is the legal version of Dennis Rodman and it is sad that so many El Pasoans believe her hype machine. Good thing there arent enough to get her elected

Judge was from San Antonio =South Texas. Dallas is North Texas, Austin = Central Texas. Houston is East as is all the way up to Texarkana. San Antonio has a high hispanic populaion btw so i doubt the judge was a clansman. Please have some perspective of our state and its demographics and culture before you spout out such ignorant rubbish. This board is starting to resemble a Caballero Courtroom. "They're all against us!"

I look forward to watching this unfurl. This judge is a perfect example of why the legal system in this country is becoming a joke. Someone needs to remind the judge that respect is earned; it is not an entitlement and doesn’t come as an accessory to the robes. The disparity between the fines assessed against the prosecution as opposed to the defense shows clear bias. He thought he was going to roll into town and ride roughshod over the defense; and in fact he probably would have been successful with most attorneys. Leeds and TC however actually believe in justice and that makes them a threat to the status quo. It’s sad that “justice” so seldom makes an appearance in a courtroom. As far as the bar association goes – it’s the other reason the legal system is becoming a joke.

I am reasonably sure that at least a portion of your statement is inaccurate....

This comment is coming from a third person, who is uninvolved. I would hire Theresa Caballero for my attorney if ever it was deemed necessary. She is committed to whatever endeavor she takes on. If everyone had the passion she has (some call it anger, but it is passion) the world would be a better place. I think she is outstanding.

The only problem is that in El Paso, not guilty doesn't mean a damn thing due to the ineptness of EP jurors! "Ay, she looks like my tia Cuca, she can't be guilty." I've served in juries and I've heard those comments sadly enough.

I think she's hot. I'd hire her if I ever went to court.
