This statement clearly links the courts opinion that marriage is related to procreation, it is further shown by the fact that this statement came from Skinner v Oklahoma, a case dealing with castration.> They declared it a right which in that case happened to include procreation. The fundamental right being part of life liberty and the pursuit of happiness. In no way does it declare procreation as a mandatory marriage practice. Procreation although central to Skinner, is ancillary to the practice of marriage. Yawn.. "Our Court has not recognized a fundamental right to marry that departs in any respect from the right defined by the US Supreme Court in cases like Skinner which acknowledged that marriage is "fundamental to the very existence and survival of the [human] race" because it is the primary institution supporting procreation and child-rearing (316 US at 541; see also Zablocki, 434 US 374; Griswold, 381 US 479). "..."In its brief due process analysis, the Supreme Court reiterated that marriage is a right "fundamental to our very existence and survival" (id., citing Skinner, 316 US at 541)—a clear reference to the link between marriage and procreation. It reasoned: "To deny this fundamental freedom on so unsupportable a basis as the racial classifications embodied in these statutes ... is surely to deprive all the State's citizens of liberty without due process of law" (id.). Although the Court characterized the right to marry as a "choice," it did not articulate the broad "right to marry the spouse of one's choice" suggested by plaintiffs here. "- Hernandez v Robles

lides wrote: <quoted text> You had better get to work on an argument that is actually on topic. Do you find it the least bit odd that you have to make a completely tangential argument? The laws you cite each serve legitimate state interests. Can you indicate any such legitimate state interest served by denying same sex couples the right to marry? You certainly have not thus far. <quoted text> That is a lovely rationalization, but it is rent asunder the second the state allows an infertile heterosexual couple to legally marry. Doing so inherently proves that procreation is not a legitimate interest of the state relative to the legal protections of marriage. It is foolish to even think that there is a procreative requirement of marriage that is solely applicable to homosexuals exclusively to exclude them from equal protection of the laws. <quoted text> It is easily dispatched by the fact that the state allows infertile couples to marry. This isn't even a particularly strong rationalization. <quoted text> Funny, you are the one making irrelevant arguments that don't pass even a rational basis test. I am not interested in debating your opinion, your opinion doesn't mean sh$$, and neither does mine. That is why my posts contain direct references to those people whom's opinion's do matter while your posts continue to be void of them. There is a big difference between how you THINK things should be, and how the ACTUALLY are..

"Natural rights are rights not contingent upon the laws, customs, or beliefs of any particular culture or government, and therefore universal and inalienable. In contrast, legal rights are those bestowed onto a person by the law of a particular political and legal system, and therefore relative to specific cultures and governments." "Fundamental rights are a generally regarded set of entitlements in the context of alegal system, wherein such system is itself said to be based upon this same set of basic, fundamental, or inalienable entitlements or "rights."
It follow then that because it is perfectly "natural" for a gay or lesbian to seek a mate of the same sex, and because such "natural" rights are not contingent upon the law, customs or beliefs, they are both inalienable and universal. To deny such fundamental rights as the right to marry the person of your choice is unconstitutional.

This is what Mutt Romnutz believes: "Why is Mormonism a non-Christian religion? It is not Christian because it denies that there is only one God, denies the true Gospel, adds works to salvation, denies that Jesus is the uncreated creator, distorts the biblical teaching of the atonement, and undermines the authority and reliability of the Bible."

Unfortunately, there are still to many who've either drank the 2 party kool-aid or are fiscally tied to the two-party debacle.
