Cancelled contract - now Toll wants the Note

I recently canceled my contract with Toll and now find that they want the note which equates to 5% of the base price of the house.
Has anybody else had experience with this?

Toll brother Suck's they do not have ethic. First they kept our deposite of $35K. Now they are demanding more $35K. No other builder does this.

We have waited over a year for our condo to be finished. "Luxury" is a joke, the very cheapest finishing touches possible have been included in the end product and you're not made aware of it until your place is close to finished. It has been one aggravation after the other and of course it always costs the buyer more money. If you're interested I can give you the gory details.

Read the paperwork that you sign! Understand fully what you are doing. You people are blamers pointing fingers to make yourselves feel better. If you cannot afford a new home do not buy it! It costs money to move up. If you cannot afford it,, do not, if you can, go for it....read read read DO NOT BLAME SOME ONE ELSE FOR YOUR INADEQUACIES! You make the choice to buy and sign. Not Toll. Read you paperwork and understand and you will be fine. Toll Brothers is a great american company that is just trying to provide for their people, not swindle everybody.....

I have mixed feelings about my Toll house.

Yes, the finishing materials are cheap--plastic TP holders, cheap light fixtures, etc. That is very upsetting to me, as it is not befitting a 'luxury' house. The house seems mechanically sound and the neighborhood is being developed by Toll in an extremely nice way, so that should help property values tremendously. The Toll people on site seem anxious to fix problems and make homeowners happy, and nothing on my punch list has been denied.

However, the oversight during building was lacking, and my house has damaged cabinet doors, nicked floors, and lots of gouges (some small, some large) in door frames and windows where things were hit accidentally during the building process. My punch list initially was at least 45 items, most of them quite noticeable and truly problematic. My 6 month punch list is even longer, because i keep looking around and seeing new (obvious) cosmetic problems, and some new minor mechanical ones. I've spent so many hours at home waiting for workmen to come and fix things, and the 30 day punch list is still not complete, 5 mos later. Very Very FRUSTRATING.

I'm not a naive homebuyer--I have had 2 other homes before this, one new, one semi-custom. Neither had the number and degree of cosmetic flaws of this house. We hired an inspector to oversee the building of the house, and that was a good move--I would recommend that highly.

Toll has a buyers feedback program, and they ask specifically if the buyer will recommend their homes. I told them "no"--no way would I want my friends to go thru the disappointment and frustration of having one of their homes. Maybe things will improve and settle down over the next 6 months, so that we can just enjoy our home, but so far, it is not happening. I simply cannot understand why Toll allows stuff like this to happen to their customers. It is bad business for them: it leaves a bad taste in the customer's mouth, and makes the customer feel that they will never ever buy another Toll home in the future.

The homeowner referral questioner is to determine if the construction crew is to receive their bonus. That is the sole purpose. Yes the division pres will look at it and chew some butt if they get bad ones. I know for a fact that if you send in a negative report they will call you and offer you the moon to get you to change your mind and refer them to a friend.

Stick to your guns. I have seen them give away the farm to get a positive response on these questioners.

Its funny how everybody here is twisting ideas and concepts. Of course to make the result come out the benefit of their ego. Opinions of negativism on a dynamic situation that has multiple variables. Be positive and support great american companies and read your paperwork and quit blaming others for your problems, they originate in your head........

If you want a "custom" home, pay for one, buying a home from TB is like ordering out of the Neimans catalog, off the rack, with great customer service..l It is a great product, better than average and, actually above average. Where else can you go and get a marble entry, grand staircase, foodie kitchen, outdoor amenities... too much to mention. Bury your demons and accept the truth - you can't afford the custom 2M home. Give it up. Money down is money down, if someone has enough to pay, you pay. Otherwise, go play somewhere else. Or, stop crying over your inheritance issues.

I agree with you tired. Toll has built me a beautiful home. I am completely satisfied. The materials used are top shelf along with the architecture. I loved my construction manager he was wonderful. But life and business are dynamic, every experience is different. I am sorry for someone having a bad experience, but check you subdivisions. Make sure they are good. You should always drive the communities you are thinking of buying in and ask the homeowners that live there. "is this builder good?"do your homework before you spend the multi thousands of dollars..meet with your manager...

BTW - Toll doesn't have a community in The Colony so where did you build? Frisco? Lakes of La Cima?
Hmmmm?

This company treats its employees unfairly and builds crap. If you are happy GREAT for you but others are not as happy or maybe lucky.

If you canceled your contract prior to the 180 day "out" clause (if you have this in your contract - not sure where you bought, etc.)- i.e. if you defaulted - Toll can go after the note - this is specifically why they include a note -when sales were strong - the company was happy to let people out because they could resell at a higher price - in today's market, the company is aggressively pursuing all of its rights under the terms of the contract and will aggressively go after the note

Our sales agent told us atleast 4 times that they would not go after our note - We were not worried because we signed a delayed closing contract last July - wellllllll - now bcause of this new economy it looks like our house may not sell - Hopefully it will - but my question is this -
1. Did a sales agent tell any of you that they would not go after the note - and say that she asked her boss and they said they would not go after it.
2. Did you make every effort to buy the house and because of the economy not sell - i.e dropped price, open houses, marketing like crazy..

For anyone that worked at toll - do you think they would honor their word - could it be a fraudgelent(sp) contract because we signed something they said - just sign it - I have never see anyone have to pay it if they truly made a good effort to sell.
