Counseled today for 3 times going over the 6 hour mark. Of course I was helping customers but federal law is there for our protection, otherwise we would be working 12 hour days with NO lunch break. If I have one more lateness or go over the 6 hour lunch mark---I could be gone. Wondering if it is legal to fire one person for an infraction while other employees have many more of the same infraction. Is this at the SM's and HR's descretion? I was told that an employee could have 4 latenesses and be fired, while another might have 20 and not be fired---is this was legal?

It is 6 hours into your shift if you are working 6.5 hours or more then a lunch must be taken. If you are not working past 6.5 hours then no lunch needs to be taken.
Orangeokie, they essentially have to treat everyone in your box the same. If they count 4 lates as grounds for firing one person then they have to take that across the board for everyone otherwise it is not legal and you could sue. The problem is you have to prove that other people are being treated differently than yourself.

Am waiting on repsonses from the Feds and NYState labor Dept. about the 6 hour rule. And I am armed as far as evidence---is necessary when you start feeling like you're being singled out. I could not use the racial bias or any other discriminatory reason if they did fire me. Tough working in an environment where you feel paranoid. As far as favoritism, there are no laws to protect against that. But, where company policy,Fed and State laws go, I would think all must be treated equally. I was told they are trying to weed out the loafers/non productive employees. My solution for part timers, at least, is, give them 2 hours a week and they will quit. Why go through all the documenting? Or just fire them---period.

Orange, give me your email i will send you some stuff. As for NJ its 7 hours but we push 6.I was a operation Manager and know ALOT. I have no more ties to the company so i really dont care. As for treating all the staff equal, you will never know and the pen is very quick to change something done it plenty of times. Anything i could do to help i will.

I believe the info is on the Federal Labor Webpage under Discrimination or Equal Employment Practices. It has been about 10 years since I touched any of that stuff so they could have changed it or even moved it. And Laidoff is correct, the only way you will ever know is if you talk to the people who have the massive amount of lates and they confirm this, and even then it takes someone being willing to stick their neck out to help you. And that pen and the shredder are pretty quick when they want something to go away.
Good luck, my only advice at this point is to try to be on time and if you can't talk to the manager on duty and record it in a little note book. If your store has a variance book become that things best friend.

Had two latenesses in May and was counseled. The recent one was for Sept. and I was 8 minutes late. But had a couple days where I went over the 6 hours law, helping customers of course---big sales. They have been calling in half the store, so I feel better that it's not just me. Feel troubled that one guy was in the middle of a $4000 appliance sale and called an ASM to ask if he should stop and go to lunch or continue with the sale. He was told to continue. Then a week later he was called in for going over 6 hours. They have to be kidding. But they weren't. What worries me is when they have the need to let employees go, it's in the records and they have their reason already. Time and the economy will tell. In the meantime, I am writing all the people down with all the info on who does and does not have lates or over 6 hours---on my time---not HD's. I believe if they try to fire some people----lawsuits will follow in abundance. 9 years ago there would not be a Home Depot forum with employee complaints. It's a shame.

Lets be honest here The homedepot is going into the forth quarter of the year and to make up more profits they target the associates that make the most and have been with the company some years - ASMs are been laid off they look for any excuse to fire someone and replace you if they replace you with a lower paid know nothing - Its a wonder why customer service is so terrible at home depot - The sad thing is they ruin the careers of so many people - but betcha the CEO will get another nine million dollar raise next year

i do understand most of the problems mentioned in this forum.I have been with HD for over 18 yrs and been at different stores.When i was a dh i did the schedule and it was set and names moved each week until you reach the top and you got a 3 day week end. we shared all shifts.Now with the comp. and ac i get mostly 10-7 shifts Oh for the bernie days and real customer service and no pets for the ops manager for good shift.they will figure some way to get rid of me.good luck with comp for lay off.

The great and Powerful Orange HD just "terminated" me for no other reason than being tardy - something I haven't run into since 6th grade. You'd think they could have at least given me a detention. Seriously; I have (had) positive reviews - silver homer badge, written up as in "great work Reggie" on the VOTC and none of it mattered. Watch your back, your Ps & Qs - and read the SOP. AND, You might want to carry some vasoline. Good Luck.

The week before he was termed, he had missed 2 days and come in late 3 times. Just wondering how they get away with terming some and not others with the same number of latenesses and calling in with no sick time left. When things get tougher giving out hours, everyone will be at risk except those who are favored---not that those favored work hard---just that they are liked by the SM. Part timers have been cut to the bone already. Our pat timers on overnight crew, which we are lucky to still have ---have zero hours for the next few weeks and I imagine this could last until early March. Bad time of year to get fired even when the economy is good. Sorry.

Favoritism runs high at the store I worked for , they even put 18 year olds in charge of the paint department and as head cashiers. They had no experience and of course the store is suffering now.

Favoritism does run very high in the store I work at. Management never offers Dept. Head positions to the older workers......only the young people get any opportunities of advancement. Then the younsters have to manage us older workers......many of whom have socks older than these snotty nosed up-starts. Seemingly age discriminatin is alive and well.

Right on, that is a norm rather than an exception, in at least three stores I have been involved. Bubba, what are going to do about it. I think when some thing wrong is going on, if you are a bystander doing nothing to make it right, you are as guilty as any of those who are commiting the crime. There is a law in the books, that prohibt the act that you are talking about, make sure it is enforced to make the wrong righted.

The problem in our store the firing frenzy is firing the wrong people. If you are going to fire someone atleast get it right and fire the dead weight. Oh excuse me those are the ones with brown noses.

Don't look for justice at Home Depot. You will not find it. They have a strategy to make older, higher-paid workers quit and replace them with younger cheaper labor that does not question authority. This is going on all over the country. They fight every unemployment claim, they fight every instance of EEOC or state complaints. They only way to let them know how you feel is to get another job, be happier, be paid better, and NEVER USE HOME DEPOT AGAIN even for a nut or bolt. Encourage your family and friends to NEVER use Home Depot again. That will make a HUGE difference. They are getting quite a reputation, let's help it along, shall we?
