I was terminated from my postion as a BAM yesterday due to production. I was with the company for almost 10 years and was just told that they were firing me. I feel like the reason it was done like this is because they kept saying the branch needed to be a 3 person branch and this was the easiest way to do it without having to do a severance package.
What branch did you work in? Was it in Alabama?

I am very sorry to hear about this. If you don't mind my asking how bad was your production and how long had it been really low? Not trying to be nosy just trying to understand how they are making these decisions... I too am a along time employee and my productions was AWFUL last month...I had the highest production in my district in Dec and the lowest in Jan and this month is not looking good either...my branch is STRUGGLING to find loans right now. We can't even find RBO's....

citifinancial is just trying to find ways to get rid of you without having to pay a severance package. production sucks for everyone and so is delinquency percentages. we are just soliciting the same customers over and over again. we are not getting new customers. how do they expect us to survive in this environment. it is not fun when you get calls threating your job because you are not able to get loans when that is all you are doing is soliciting all day the same customers and the customers are not answering their phones or not responding to the mail solicitation you are sending out. gettng written up on a "pip" is just sad, sad way to threaten your job.

What is the current severance package? If it has been announced that Citi Holdings is in the process of either selling or liquidating doesn't that give everyone who no longer works for Citi holdings the legal right of a severance package? What is the difference in being fired and being laid off with severance package? If one "quits" are they legally eligible for the package or would they have to file a class action suit?

If you get fired or you quit, you are not intitled to any severance package, only if you get laid off. If you believe that you were fired for other reasons than what you were told, well, that another "can of worms".

My understanding is the employment contract you signed said that you were entering an "at will" employment contract. This means either party can terminate the employment "at will".

If you quit, you terminate the contact meaning you cannot negotiate a severance. If Citi fires you for "just cause" they have terminated the contract and are under no obligation to negotiate a severance with you. Layoffs on the part of Citi does not qualify as "at will" termination. They have no "just cause" so they can, if they choose, offer you a severance. This does not mean they are under obligation by law to do so.

Class action is a different matter. In this case you must prove that there has been a violation of employment law in which case you sue on behalf of the "class" which is any other Citi employee who separated from the company under the same circumstances YOU did. They then become part of the "class" IF they choose to. You have the burden of proof in these types of cases. You must show the court you were released from the contract under conditions not related to "just cause" on the part of Citi and not released under your own willingness to leave the company.

My advice is that if you are this disgruntled and unhappy with Citi that you simply leave the job and hope for no severance. You will most likely NOT win any class action or any other legal employment case against them.

you are so right it is no way to win a legal suit against citi they are thieves and are in bad with the government, stealing our money to pay the lawmakers to rule in their favor, I have first hand experience

right, everyone's production is horrible ,cannot understand why the doors are still open, it is a horrible loss for citi. At this point there needs to be major layoffs to save costs.
