"if you don't like the practice, your only remedy is to not use our service[s]," reads privacy policy/terms of use of western online services/websites.

Baidu offer a free service so I fail to see how they can be sued for something that they are not contracting to provide.

Lawyers will get rich out of this assuming that China and Baidu don't decide to treat the action with contempt and ignore it.
