I was charged $70.00 by Bank of America for transfering funds from my checking account to savings. on 8/10 I made a cash deposit of $200.00 after 3:00 pm. When I returned home from work that same evening I went online- to check the balance of my account and it showed the funds available not "pending". I completed a funds tranfer of $100.00 from my checking to my savings account and thought all was well leaving a balance a little over $100. in my checking acount.
I checked my account this morning 8/12/and I had been charged a $35 NSF fee a $25.00 gas purchase I made at 7:52 am on 8/10 and $35.00 for the funds transfer. The bank had manipulated the transactions to cause my account to be overdrawn by the $100 funds transfer.
When I contacted customer service, she stated that she had tried to do a reversal based on the information I had provided by was unable to because the final decision had already been made - I was transferred to her supervisor who stated I should have made myself aware of their policy that they can decide when and how to process the transactions at their discretion and usually by aplying the highest balance first.
When I hung up with the customer service, I called the local branch and they took my information and said they'd return my call. They also told me they could not reverse the charges. I pulled out the 81 page Deposits Agreement and Disclosures booklet I received from the branch when I first opended the account (11/2004) and low and behold on Page 57 it states under the title: Check and Item Process Orders:
"We may in our sole discretion change our priorities, categories or orders at any time without notice to you. Even if we provisionally post checks or other items to your account during the day, we may treat them as if we received all of them at the end of the day and process them in any order we choose. we do not Process transactions in the order in which they occurred."
I want to make as many people as possible aware that Bank of America maniipulates funds to produce additional fees for their bank. Even though I have receipts with date and time stamp proving that the $25.00 purchase was made when the funds were available I was charged. I also was charged for transferring funds from one account with this bank to another account within the same bank affiliation. BEWARE!!! BEWARE!!! BEWARE!!!!
I have taken this to the highest level of customer service and will provide an update if these funds are reversed. I have filed complaints with the BBB, FL State Attorneys office, local news and I will take this matter as far as I can until the bank ceases this practice or reverses these charges back into my account.

Loan officer misrepresented terms of 2nd mortgage on my home. She said the 2nd loan would not carry separate charges for anything and that was not true. I paid separate charges in escrow charges and when forced placed insurance was put on my home it was places on both loans. totaling over $4000 FOR ONE YEAR.

Stay away from this company!!! Bank of America is a bunch of scammers. I had a platinum card with this company for 3 years and never made a late payment. Last month I sent in a check 6 days before the payment was due. On my current statement, they had the payment post a day after is was due, charged me $39.00 for the late charges, added $19.84 in finance charges and gave me a new rate of 24%. I dropped this Bank of America like a bad habit and I recommend that you do the same. There are so many better companies you can deal with. Come on Bank of America, I have a 740 Equifax score.

Bought a Dell computer on line. Since I had it shipped to my office, Bank of America denied the charges & several other charges we made after that.
They never called to confirm, they sent us a letter that I got a week after trying to purchase the Dell.

I charge many thousands of dollars to this card a year.

Someone else should have this business

wow! And I thought Best Buy was bad! BOA takes the cake.... they posted my Direct Deposit (pay check)**** Same account and same job for over 20 years!***** then the next day they pull it back and bounce a $1,500.00 check and repost my Direct Deposit 1 minute inbetween each other!!!!!!

scammers! 20 years with the same account! I have been Barnett Bank, Nations Bank and now Bank of America..... NEVER EVER have they pulled a stunt like this! I have close to $1,000 in these so called "fees" this past year. They just seem to get more gutsy with each charge! I am closing my account and getting the HE** out of this bank~

I was a customer of MBNA Visa for years and
never had a problem with late payments. Within
a couple months of this being Bank America, wham
a Late Fee of $39.. Does the US MAIL have something
against Bank America, I don't think so, but I do
believe Bank America, by design, does not process
payments in a timly matter, therefore they collet
outragous fees for "Late Payment"? I have heard
others complain about this scam, of course I am now doing business elsewhere.. Bank America puts
a whole new meaning to the words "Bank Robbers"!!

I have my payroll direct deposit split between a BOA account and a USAA account and I notice that the BOA direct deposit always shows up at least 2 business days later than my USAA account. I'm sure when I call to inquire they'll have some bs reason to quote like having to wait to clear the payroll or something but somewhere deep in the bowels of their deviant policies I believe this conveniently gives them 2 more business days to use my funds to back their investments.

Well, what happened? This just happened to me and it's the last straw. I've been charged $140 in fees to cover 4 charges less than $10 each and had already been deducted from my account balance as pending transactions. I was told they apply the highest charge first, and this is a change in their policy that they used to apply the smallest charges first, so that people's mortgage, car payments, etc. would not bounce. I got the runaround and don't want them taking any more of my money.

Mr. Kenneth Lewis, Bank of America your bank seized a widow's savings when the act of conversion was done on her accounts that she held in trust with Bank of America. Further violating her with a lawsuit when she was a victim of fraud. The case was dismissed a month ago. Return #6937 without further delay.

The Following describes how they robbed me. They do not care about customers, they care about NSF fees.
I am leaving this bank, and it will be the last dollar they ever get from me. Im going to talk to the BBB and my congressmen about the laws that allow them to take my money I earned. a mistake cost me good. now had I not paid my gas bill they would of sent me another bill with a $3 dollar late fee. instead this cost me $100.
I am going to file a small claims law suit in my county against the bank, If the judge says they can keep the money, then they can keep it. We will let him decide.
I am going to make up flyers and pass them around my neighborhood, of this letter. I think I'll do 200 or more. Send my kids out on their bikes and give them to people. This should not help LaSalle in my town. Word of mouth hurts crappy companies that take what they did NOT earn.
I am going to plaster this all over the internet.
I am going to file complaint with the city, state, and federal levels.
Im sure this will just add to the rest of the people that Hate Lasalle bank and maybe a consumer bill will pass soon.

Deposits are made from a transfer first.

Bankk of America ruined me financially after I was the victim of ID Theft/Fraud. They took 4 accounts, made 14 acct. numbers, then all 14 went into 2. I gave them ID Theft affidavits, they cut my credit limit so I am always over on fraud balances, and I get no where when I call them. They closed the case, but the police reopened it. They paid other creditors with fraud balances even after I deleted them from their site. They even took 'offset' money out of my checking to pay their credit cards. I am financially ruined and they won't respond

I am a senior and also a victim of thousands of dollars over the years. Who can I write or contact to have these issues addressed and it's not just BOA. Its Wachovia, Suntrust and may others.

Same issue. MBNA customer since 1996 never a late payment showing on my credit never a late fee. I also used auto payment during my deployments as a military officer. During my last deployment MBNA sells out to BofA. Three times I tried from overseas to reestablish the auto payments each time they worked for a month or two and then stopped. Each time they stopped I was charged a late fee and dinged on my credit report. In 10 months 4 30 day late payments. Now I am in danger of losing my top secret status. These people are really bad. They think they are so big no one can touch them.

Not only do they keep raising the interest rate- but also they change the "due" date every month so that my auto payment falls in the wrong month and I am charged late fees and finance fees! When I paid on the due date – it was not posted until the next day- so late fee went on. They would not remove the fee- so I canceled the card. This was a AAA visa- and I am hoping that AAA will assist in removing these charges. I also hope that they take action against these despicable practices being done in the name of AAA

When I paid on the due date – it was not posted until the next day- so late fee went on. They would not remove the fee- so I canceled the card. This was a AAA visa- and I am hoping that AAA will assist in removing these charges. I also hope that they take action against these despicable practices being done in the name of AAA

I have 2 checkings, a savings, a mortgage, and a credit card with bank of america. I have my mortgage and credit card on direct debit and have never in 5 years had a late charge. I have never had an overdraft fee because I BALANCE my checkbook. oh yeah, does anyone do that anymore? It doesnt matter what order your debits post, if you don't have the money THEN you overdraw the account. The bank cant make you overdraft, and you would think after paying expensive charges people would take responsibility and balance there checkbook, my mom taught me that when i was 14!! Lets get with it we are adults are we not? Same thing with charging, the bank didnt ask you to spend money you didnt have and they are actually trusting you to pay them back on time.

Things would be all fine and dandy if that was how it actually worked. Unfortunately, even when you HAVE the money in there (you transferred it in or made an ATM deposit) BofA is still really good at finding a way to change the order of things to screw you over. In other words, your answer is basically "don't spend what you don't have" but if I took your balance book, cut each transaction into little strips, and then reorganized them -- you'd go in the red too (unless you happen to be rich, which most of us aren't). It's simple math, "Banker Girl," -- you change the order of transactions and even people who put the money in there before they spend it can get duped.
