O.k. I am tired of being bashed and being treated rude by some of the ex attorneys who worked at Albertson's in the other threads. So I am making this one for others who have liked my post and want to get information. Also for others who don't know it all like some others who seem to know everything. If your an attorney keep out of my thread. I want this to be about people who are getting screwed by the attorneys who worked off the clock at Albertson's. Also for people who want to share information about the law suit.

I am posting copies of my other post from another thread because I am being talked to very rude by people who probably work for the law firm. Anyone can post there and I have said nothing wrong. Nothing that was not true. All the post you see are copied post into this new forum. If anyone wants to be rude or talk about the meds they take or how many psychopaths they know or about dog food or how wonderful the law firm is then go to the other forum and post. Not here.

I am extremelu upset. The offer I am getting in less than $50.00 for off the clock work. They have also refuse dto send me a copy of the "Agreement". They want you to sign papers and release them and send you the money later.???WTF??? They have undermined a lot of peoples intelligent and played us all for fools. It's really sad that the UFCW even hired them to reprensent us. I agree with some of the fugures above. They are telling me that you only get money for "off the clock" hours ...
Nothing for pain and suffering. They are telling me that if I sign I must keep the agreement and settlement confidential. I had a min of 4 hours a month X 12 months on my claim plus pain and suffering. 8.50 an hour but you get time and half which means I should at the very least get time and half for 40 hours. That would be $510.00. So why witf are they offering me $50.00???
It makes no sense when my claim was much higher than that. The law firm offered me an additional $500.00 because they thought that amount was to low. Yeah right!!! Look how much they are getting paid and look how much they are giving all of us. Needless to say I'm livid. I have been to their depositions. Paid parking fees, paid long distance phone calls for over 6 years now. Oh and dont forget the postage every year when they send you the forms to fill out over and over.
And WE are the ones who suffered working under the conditions we worked under, not the law firm. I am upset because I was told "Oh I'm so tired of hearing from all you people how unfair your being treated because you did not get hardly anything" and then this person went on to say at least you have something now..Oh please!!! Just stop it. Yeah right a $50.00 settlement out of millions of dollars they are getting will buy me some toilet paper.

Oh goodness....I can talk right now because I have not signed anything or any kind of agreement. I want to see the actual agreement. I have letters that claim I was in the original agreement, then the second agreemnet and now the last agreement. And not even knowing which settlement agreement I am in I don't even know which is fair. I would also like to know If they paid anything extra besides the hours "off the clock"...
I was originally told that we would also be compesated for pain and suffereing. Not just off the clock hours. So I agree with all of you. And it a dam shame that I have to hire an attorney to get copies of the agreement and help me decide whether their offer is correct. I don't even care about the pocket change they want to give me and I would rather give it to an attotney to make sure my interest are protected.

I agree they used us to make millions. Whats worse is that they have kept the money several years purposely while racking up their attorney fees and claiming they can't find you... All the while they know exactly where you live to contact you and give you the money. And most of us have constantly keep in touch with them and updated our address and phone numbers. I think it's funny they can't find us to give us money but they can find us to get their (Depositions, phone calls, signing their ridiculous yearly documents).

It's all BS and I think the UFCW should investigat them and how they are disbursing the fund to the claimants involved in the class action lawsuit. I have NEVER seen or read anyone in a class action lawsuit get so little from a lawsuit. I would think it you agree to the amount they offer you and release them then by law they keep the rest. They claim the checks are coming from Albertson's. How can that be??? Albertson's no longer exist. Another company owns them and have started with a clean slate. They also are not responsible for any monies owed in a class action lawsuit.
I believe the checks may read Albertsons because it is being drawn off some kind of trust fund for the claimants set up by the courts. So I guess the law does not really care what we get as long as they get their millions. I would be interested in what other people have been offered by them. As far as I know nothing can be used against you if you have not signed to any confidentail agreement with them yet. I belive that once you sign you can't post. You can tell anyone how much money they gave you or how terribly screwed you got in the lawsuit.
BTW, if anyone feels screwed you may want to talk to the ones who hired this law firm to reprensent you. The United Food and Commercial Workers Union. They are the ones working for us in this lawsuit and who are the ones who hired the attorneys. Check out the settlement and see their web site.
http://www.ufcw.org/press_room/index.cfm... ... Type Albertsons in the search area to pull up all the info. |

You can also check out the information that is posted for us to read on the attorneys web site. It does not include all the settlements or agreements and it leaves us being "stupid" as to what is fair or not fair.Furthermore, If any attorney represents you in any case, anywhere, anytime, and they get PAID for the job, they are required by law to give you a copy of the ACTUAL agreement. Not send you to some court where the motions are filed and tell you to go get it yourself. It's like this...They want you to sign everything blinded. TOTAL BS!
The attorneys web site---- http://www.albsuits.com/FAQ_Claimant.html |
Now do any of you see all the information from all the different class action lawsuits there? No. They are not there. So how in the hell are we supposed to know what we are awarded??????????
The only thing I can get online is the actual motions filed in the 9th Circuit court. You can check it out at - http://www.ca9.uscourts.gov/coa/newopinions.n ... I learned a long time ago to be careful with attorneys. And I also know they you never agree to anything in "shhhh, hush, hush" sceniro. WTF?? WHy??? |
Every Class Action lawsuit I have ever read about discloses the amount the people involved will get. SO why would they make an offer and ask us to be quiet about it???? Anywho...Guys you decide to do what is best for you. BUT I am on your side!!!! I am with you all on this one.

Before I go----
A little joke about attorneys A lawyer was in the hospital on his death bed and he knew he was going to die (very sick) and his friend cam eto his room to visit him....His friend said "Hi, how you doing today?" The attorney said"Not so good"....The friend then ask him "why are reading the Holy Bible, your not religious" giving him that dumbfounded look:):):)??? The attorney looked up at the man and said " I'm looking for loopholes so I can go to heaven".....:):): Yeah!!!! Smile you know it was so funny!!!! And hey guys, This lawsuit is only about money. We survived before this suit and we will survive after it. BUT stand up for what yo believe in and fight for your rights. Enough said. Laters |

You claim we should be happy if we get anything. Yes, sometimes something is better than nothing. I agree. But only in cases where all are treated equal as in a "class action" suit. They are called class action suits so that the money is disbursed equally to all the people involved. So WTF do you think it's fair the attorney get millions and we get chit? Furthermore while your posting your garbadge on here honey, go ahead and post how much you guys got paid per hour and how much each attorney who worked on the cas got out the the (individually) as oppsed to the people involved in the law suit. The people should get more than the attorneys get in this law suit. Someone should investigate and look at all the figures. Furthermore, you stupid twit, I don't think anyone wanted to follow you along on 6, or 11 year journey and waste their time and money being involved (which a lot did, Depositions, phone calls, mail) and be mislead to believe they would get paid for their off the clock hours plus pain and suffering on to be offered $50.00 idiot! No wonder you no longer work there. Maybe your the one who screwed up the whole case and everyones file. You need to get the hell outta here cause there are a lot of pissed off people here and we don't need to hear anymore garbadge and shit spew out of your mouth. So leave us alone, stop calling us name. WE are the victims! Not you. So WTF are you even doing in here. Tell us what we really want to know or leave. Why do you get millions and we get chit? Waiting...1,2, 3,.... How much did each attorney get paid you walking encylopedia? Waiting 1,2,3.....
Well...I get another story from the horses mouth!!! I am not shocked at all. I have been told I was in the origiaml one...The something called Barton, No I am being told I was EXCLUDED and am only in one called David Thompson VS Albertson's. One suit reads they got 17.3 million another one recenlt reads they got 53.3 million. So whats the total. How do we know what is being given to everyone is fair? If you no longer work there then why are you defending them?
If we are getting "individual payouts" ONLY for off the clock hours they keep taking away, then where is a copy of the agreement with individual names on it reading what each individual payout would be? I also have a hard time believeing that a UNION only agreed to off the clock work money for us. Unions also fight for damages incured. Such as Pain and suffering. I really doubt Albertson's only agreed to pay millions to the attorney and only give us deducted off the clock money for hours worked theat they choose to give us. Truly all these exclusions seem unfair. That is why you go to court. BECAUSE YOUR BEING TREATED UNFAIR.

I can't even imagine any attorney who would settle a law suit who is supposed to working for our best interest and give us pocket change and they make millions for their law firms. It's BS. Anywho. I'm not goingto agree or sign their papers. I am going to get an attorney to do everything for me becuase I don't trust them. I REALLY don't trust them after reading everyones post. I thought it was just me until I came across these blogs. I bet everyone is getting screwed by them. But take that off the record. I can't prove it yet.:) Laters, And take care everyone. I am so with you all on this.
