A Warren county appeals court has upheld a court order that forbids a local mother from smoking around her daughter.
A Warren County court made that ruling in December of 2008 and the Ohio 12th District Court of Appeals in Middletown upheld it on October 26. That order means no one is allowed to smoke around 9-year-old Victoria Anderson of Dayton.
The case began after the child's paternal great grandmother, Marilyn Anderson, objected to Victoria's mom smoking around her.
Marilyn Anderson has custody of Victoria but she does get to visit her mother. It was after those visits, that the child came home " smelling of cigarette smoke" according to the great grandma.
