Ask a judge or CPS worker. Things may get tighter over time, as virtually all protections relative to smoking seem to be doing. Personally, I am still rooting for the folks who are hunting safe, effective ways to neutralize nicotine addiction. That, I think, is the only way to make the problem go away. BTW, a smoking spouse (not talking the "burning mattress" thing here) is an impediment to a quitting effort, but could be invaluable as a "support group" member if you agreed and were both serious to quit at the same time. It is also useful if you can find something unrelated but meaningful to connect the quitting effort to. I quit 35 years ago by focusing on how much it would please a family member (not one I lived anywhere near to) and how much I would like to please her. I wish you luck.

The specific context of protecting children (not ones own) from the effects of nicotine addicts in their environment is a little different. There was someone who said that the great problems of the world are not the result of actions of bad people but of the inaction of good people. Addicts are not necessarily bad people, and addiction is mostly at the root of exposing children to concentrated ETS. However, PROTECTING children from ETS is the action of good people. Inaction would, as in the old saw, be cause of significant trouble. Sorry for your luck and your bitterness. No one is being discriminated against in this scenario.
