This is clearly another glaring reason why Ron Moore needs to go- now! As Vinson said in the above article "Many people including myself were disappointed in the death penalty being taken off the table.This was cold-blooded murder. I don’t know what the death penalty is for if not for this.”
I've seen Moore wimp out on these kind of cases over and over through the years. People like him is why our justice system is becoming meaningless and idiots like Beavers continue doing attrocious acts such as this knowing they'll be treated lightly!
We need authorities with some backbone and this kind if idiocy would decrease greatly.

I agree this guy should get the needle.

However, for someone who kills out of emotion and desperation, the deterrent factor of the death penalty is non-existent. The guy was a nut, I'm pretty sure he didn't rationally weigh the live in prison versus death arguments.

It's ridiculous that this man can't be considered for the death penalty. This was a premeditated murder, hands down. And he killed this doctor in front of his friends and coworkers. Exactly what does Moore need for a crime to be considered heinous?

There are a lot of people who lose loved ones to illness, and we don't go and shoot the doctor. He should have been grateful the doctor did all he could to help his son. Brian Ling was a good man, a loving father, and a renowned doctor. He didn't deserve this, and his family deserves to see some justice.

This is not to dismiss what people are feeling, this was a horrible crime.
The guidelines prosecutors use are not one line passages in the criminal code/procedure. They have to weigh any aggravating or mitigating circumstances when making these decisions. Let's say that Ron Moore goes for the death penalty. How many of you truly believe that the person, if convicted, will ever see the punishment carried out?
How old is the father? It takes years to go through all the appeals in order to carry out executions. Look at the recent case of a man who wanted to be executed, it still took years for him to get his wish.

Brian Ling was my Doctor. He was the most caring doctor I have ever had.
I lost a son in 1977. Dr. George Bilbrey tried all he could to save his life. So, why didn't I go to Mission Hospital and shot all the doctors and nurses in ER, or kill Dr. Bilbrey because they LET my son die. They did not, It was God's will that he died. Yes, I still miss my son after 30 years. If this man knew God he would have realized this. No, I thanked them for what they did. This man should be hung. If this was back in early 1900 he would be hung on Pack Square. My mother told me this is what they did with murders.
He told him away from his patients that still needed him. We had talked about Dialysis for me , but he is gone now, I like all my doctors but Dr. Ling still has a place in my heart.

So they shouldn't seek the death penalty just because you don't think the guy would live to see it carried out?
I would be happy for him to be sentenced to death and locked in solitude away from the general prison population so he could spend the rest of his days alone and miserable.

He didn't rationally weigh, maybe...but he took the time to premeditate his actions. Good enough for him to get the needle.

So how can this not be premeditated when the man walked in with a gun in his pocket? Is he saying he had it for another reason? Isn't premeditatation a reason for a 1st degree charge?

This county had a very high per capita rate of people getting the death penalty....higher than most other counties in NC. Does it bring the person back to kill another person? Would the good Dr Ling want the death penalty for his killer?

You said 'this county'. Do you mean Buncombe County has one of the highest death penalty prosecutions? UMMMMM? I doubt that. Too much plea barganing on the DA's part.

Recently Buncombe Co had one of the highest per capita death penalty rates in NC. Look it up.

YOU WERE NOT THERE THAT DAY THAT IT HAPPENED, THIS MAN WAS THE BEST DOCTOR THERE WAS, AND BEAVERS TOOK HIM AWAY FROM US AND HIS LITTLE GIRL WHICH IS VERY HEINOUS TO ME. HE HAD THIS PLANNED AND HE EVEN INTENDED MORE DEATHS AND THIS ISNT THE CAUSE OF A DEATH SENTENCE? THANK YOU SO MUCH FOR NOTHING.

Well Jesus aint gonna be on that jury, and I for one hope that it is stacked with some folks looking for revenge and punishment. You ask, "Would the good Dr. Ling want the death penalty of this killer?" Well, unfortunately he isnt around to ask that of anymore, thanks to this criminal.
