Jury selection is under way this morning in the murder trial of Francis Timothy Plaza, who is accused in the July 25, 2009, shooting of his wife.

Even if he was convicted of first-degree murder, he would not be eligible for the death penalty. There has to an aggravating factor beyond the specific intent to kill: such as a torture, or a victim under 12, etc.

What will probably happen here is either 3rd degree or voluntary. I doubt the jury will convict of first-degree. My money is on voluntary manslaughter. His actions after, by telling the son to call 911, seem to show that he momentarily lost it, which is what voluntary manslaughter is all about.

Having been through a very abusive relationship and living in the next building up from them, this really hit home when it happened. It could have been me. I felt horrible as I watched them bring those boys out. I hope this man thinks every day about what he's done to those kids. My heart goes out to the family, especially the kids.

he'll get the 3 rd degree just as the scum bobby allen got approx 15 years ago for killing my sister kelly gotwalt. york county jurors are instructed wrong. they don't consider what happens to the kids and familly after. bobby allen walks the streets after only 10 years and is remarried. murder should be murder. then again if this guy doesn't have the money to buy the best sleezy lawyer like allen did he may get more. by the way the sleezy lawyer who defended allen is now a york co judge. amazing

I remember that case - I am sorry for your loss. And I agree - 99% of the time in York County, without a well-paid lawyer, you will get what is coming to you. Judges DO favor the criminals that pay for their defense

here we go again , look at Bob Allen from 1993 , 6 shots at his new bride and killed her, left her 2 children without the wonderful Mother, and he got involuntary Manslaughter, Hello it has to stop in York, she found something out and wanted out of the marriage, well he spent 9 years in jail and he is remarried and living the good life, why, a jury who never heard the real truth, if you make me mad am I to kill you, don't think so, be a man and walk away. well at least if he get voluntary it is better then involuntary, like Allen got, in 1993 it was 5-10 for involuntary, Ridge made it got to 10-20 Big question if you murder someone do you ever deserve a trial, there is no reason for murder, I was abused by my husband but I didn't shoot him, he was a drinker, cheater and liar, I divorced him,

Ghetto Law for Cesspool York is a lifestyle entitlement ..... no death penalty, maximum plea bargaining down, minimum sentences and early parole so the perps can do it over again.

Prosecutors: he hid the gun before the argument. That, right there, makes it first-degree murder -- this killing was planned; not a heat-of-the-moment act.

My hearts go out to the Plaza kids, who've now lost both parents.

Not only is he living the good life, he also visits classrooms at York Catholic and speaks to students about turning your life around, etc, etc. My kids were students there and had to listen to his BS. I was enraged when I heard about it. I can't believe he's even allowed to enter a school. He's a convicted felon who committed a violent crime, not a motivational speaker. This guy shouldn't even show his face in society after what he did to Kelly and her children who were/are now motherless.

Sounds plausible...I don't find myself defending too many people, but manslaughter may be reasonable. Too bad for the kids having to be involved in this.

There is no accidental murder. You don't murder someone in self defense. Homicide is the act of taking a life. Murder is a legal term. It involved a homicide and malice, amongst many other factors. Its like saying my house was robbed when in fact it was burglarized. A robbery and a burglary are two very different crimes.

thanks, there are just too many things people don't know, I just ran into him and he still has never showed any remorse, he said he worked on his anger, that was in a bank after he cut someone off in the parking lot road rage, I talked to him and all he wanted to do was brag, still never saying how are you and the kids, these people who murder don't change, I don't believe anything he says, and this one that is on trial now, I am sure he wants to say bad things about her, thinking someone will pity him, I am on my kness in prayer for her family, just think what it is to look into a gun with the man behind it
