Charles wrote: Steve before u start giving out your legal advice check your facts. They have the right to walk the dog around any vehicle they choose. They do not have to get a search warrant or get permission from the driver to do so. But nice try trying to give the local dopeheads a way not to get caught. And by the way the seatbelt issue was a state law that was amended and not a local one. Again check your facts. I will reply to both of your rants here Charles: Do I smell a bacon?? Yes they can walk their dogs around your vehicle with certain restrictions legally at a TRAFFIC STOP. If they walk their dogs around your home and "cue" him to sound, or if he actually sounds, it gives them no right to obtain a search warrant for your home. That is according to rulings by that silly old U.S. Supreme Court. I was referring to vehicles parked on private property at the river. That does not constitute a traffic stop. That is a grey area that is going to be tested in the highest court. It should be no different than your home. Independent confirmations show that drug dogs are inaccurate up to 60% of the time. They are looking to please their handler, not looking for contraband. A handler can ruin one on short order by encouraging and rewarding him to sound on every thing sniffed. Therefore they have to be constantly retrained. They are mostly used to circumvent the 4th amendment of the constitution. And my viewpoint is that makes them worse than the people they seek to incarcerate. Most decent police ask permission to walk a dog around a vehicle parked on private property, with an understanding of law that it is illegal to do otherwise. My advice to the man with the river harassment post is to tell them to keep their dog away from his vehicle, and I will stand by it. It gives a lot of leverage to appeal all the way to the top. Of course if it is the Halter hole he refers to, it is open only so the police can go there to harass people. I gave credit to the cops for not planting evidence. That is a big improvement over the past. I am 63 years old and have never been in trouble. I know several police officers. I knew several in that county and city as well. Many of them used drugs and liked to party. One state trooper there had a bad meth problem. His brother, also a cop, smoked pot constantly on duty. The city prosecutor had a really bad cocaine problem. How they can hassle and prosecute citizens for doing the same thing they were doing is beyond me. As for ever needing them, I tend to take care of my own problems. The only time that I have ever called on them was to take an $8,000 thief report. They did nothing. I knew who broke in and had my property. They do not tend to bother their drug dealing snitches, and I fell into that scenario. Nothing was done at all. Of course the seat belt law is a state law. Where else are the vigorously enforcing it though? That will go to the wayside like the helmet laws. They were stopping people in Sevier county as soon as a seat belt law was enacted years back. They always had probable cause for the stop and quickly wrote tickets which resulted in heavy fines being collected for seat belt violations when it was illegal to stop folks they noticed not wearing seat belts. Like I said before, they could easily get by with one half of their force and maybe wouldn't have to stoop to their low down way of doing business to gain revenue from the citizens they are SWORN to serve and protect. If you like a police state fellow, you must be a happy camper. Me and the founders of the constitution do not. Who was it that said "A pig is a pig is a pig is a pig, is a pig is a pig is a pig" ????????

I think cops like u r a waste of taxpayers money when u make threats on line to stupid comments instead of answering to why the DeQueen police and sherrifs office did an incomplete murder investigation and refuse to allow the family or at least one member of the family to see the file on her mother's murder because I know there was more to it than just one person murdering my mother in August 1981 and still to this day no one will answer my questions or let me see the case file! If u did ur job u would have answered me instead of that stupid comment with threats!!!!!!

Seriously I do not believe that you are a police officer because you appear to be too illiterate to write a summons or to take a report. If you really are a police officer let me know where you are because you may be eligible for record breaking "dumbest law officer anywhere" in the Guinness Book of records. At any rate you are indeed a moron. Go someplace and spend 10 years and get yourself a highlights education.

Seat belt laws aren't to save lives. They are to generate revenue. How can you argue that in a state that allows 12 year old children to ride UNRESTRAINED in the back of a pickup truck or motor cycle riders to not wear helmets. Seat belt laws have and always will be about generating revenue. Our government relies largely on heavy fines and tarrifs for operation. This ironically is one of the signs of an impending communist government..tell me this isn't the good ol US of A to a tee....http://www.libertyzone. com/Communist-Manifesto-Planks .html

Well, It's obvious that "Kelly" is a police officer pretending to be one of thier old buddies. I bet if he has a fake name on a local forum he has a fake name, age, and picture on myspace.com . He should probably be in jail for Internet Stalking by now. The cops at De Queen are just as dirty as the guys they are pulling over. I can remember when they would pull teenagers over and take their beer. They took it out to parties where there were minor girls. That was okay for them to do though because they had a badge on. I remember when some of them got caught planning to kill Lawerance Lewis. This is what you call a great bunch of guys? They go around expecting free food and movies from local stores. Then they want to arrest the person for giving them free movies and ban them from the store. LOL.. They are the biggest misfits I have ever known. It's so embarrassing. The county jail is a big joke also. They steal food from the prisoners. People and churches drop off food for prisoners to help out and if you talk to any of the inmates and question them if they got it or not you would be surprised. It's the biggest scam. They put on a badge and drive around on thier big butts all day doing nothing but harrassing young girls. I really doubt Kelly is happily married. He is probably a level four sex offender and had to move out of De Queen so his buddies weren't forced to bring him in. His buddies knew he would tell off on thier scams of minor girls. Hell one of the cops married a girl he dated when she was a minor. Most of them started out as rent a cops at Mcdonalds. The sheriff won't last long. He will probably be glad to not be elected again after putting up with being whipped by the cops and prosecuting attorney. He is to afraid to stand up for what he knows is right or wrong because there might be... lets see how did he put that again... Oh he said certain repercussions towards his job.. yeah that was the words he used. Oh and I better get off of here before I get started on Mckinnley. They will call anything a man now days.... He only arrests people for selling drugs and flirting with girls because it gets in his way with his scams. He's jealous. What a big wuss..

I see my post was removed with regards to the sheriff blowing his budget. Can anyone believe all of the road blocks and shake downs they are doing to gain revenue? Maybe it would be better for everyone if they held an ongoing raffel or some other gambling venture. Or like steve said lay off about half of the deputies so they could seek a working job.

You know I do not see a problem with the laws arresting these pot smokers. Once they smoke that dangerous narcotic they become addicted and will do anything and everything to get it and will steal from their own mother to satisfy their craving for this most dangerous drug. Most suffer from some kind of insanity after using it as well. So people like you Steve should understand this and sit down and shut up and stop trying to give aid to these drug addicts. More power to the police for making it a priority and I hope all of these pot smokers rot in prison.

Hmm... I didn't realize this chat was about pot smoking but okay LOL.. I don't like pot smokers either but I think when you talking about stealing from people and dangerous drugs your talking more about meth, cocaine, heroine, etc... Most people that do start smoking pot seem to move on to heavier drugs but just smoking pot ( I'm not saying it's ok to smoke pot) doesn't seem to do the damage as the harder drugs do. My thing with this is why do they let the druggies out of prison so soon and then at their parole officer meetings each month they don't drug test them? Why is it a man selling drugs will get thirty years and a man blowing his wifes head off gets thirty years? It's pretty much that they dont get tax money on the selling of drugs I guess. Like a woman having sex with three guys for free is okay but if she gets twenty bucks from them it's illegal.. Seems like it's all about the money to me.

Another person that calls on the Sevier County police gets arrested. It is so common to get arrested from this bunch when you call for help it is scarry. Usually for possession of the legendary suspected marijuana cigatette. From KDQN news: TEXAS MAN ARRESTED IN SEVIER COUNTY FOR POSSESSION 11/4/09 A man from Texas has been arrested and charged with possession of a controlled substance after officers were called to a disturbance.
According to the Sevier County Sheriff’s office, Deputy Kristopher Hundley and Deputy Clayton Yates were dispatched to the Gillham E-Z Mart on a report of a disturbance. Upon arrival, Hundley spoke with Robert Martin who stated that a man named “Mike” had kidnapped his wife. Mr. Martin stated that his wife was hiding from the Texas police because of warrants. Hundley asked Martin how long his wife had been in Gillham and Martin said she had been staying at “Mike’s” house for approximately 2 years. Upon a routine search of his person, Deputy Yates found a suspected Marijuana cigarette on Martin. Martin was arrested and transported to the Sevier County Sheriff’s office where he was charged with possession of a controlled substance marijuana. Deputies attempted to locate “Mike” and Martin’s wife but were unable to make contact with them.

anyone remember in the early '80's when several of dequeens finest were called in front of a grand jury? police chief bill jones was tried and found not guilty for stealing around $200 from the old foks fund. officers hightower and wiggington were found guilty for beating a prisoner in the jail. they'd been beatin' up hippies as a regular habit, but that time they beat up a retired county judge's stepson. even dequeen's good ol' boy system couldn't tolerate that. yep i was one of the local outlaws. they stole my booze more times than i can count. did they finally outlaw that kind of theft? if their were any justice in the world(in dequeens kangaroo courts?) they should pay back everyone they robbed over the years. they should be locked in their own jails for stealin'. joe stacy and terry vann and their bunch were the worst type of legalized bullies.

the part ya miss is how they alway ask for and git permission to search folks' cars. who in their right mind gives a cop permission to search, knowin' they have contraband? are they bein' threatened? or are they lyin" steve wrote: Back in the days that I lived in Sevier county the city and county police were busy harassing and arresting the citizens that they were sworn to serve and protect with "possession of that there untaxed Oklahoma beer" which BTW wasn't against any laws on the books to posses except in over limit quanities as in bootlegging quanities. They "earned" a good portion of their revenue that way, until it just wouldn't fly any longer. Now it looks as though they are into coke cans. Read below which is borrowed from KDQN local news: DE QUEEN MAN ARRESTED FOR POSSESSION OF INSTRUMENT OF CRIME 7/7/09 A De Queen man was arrested for possessing an instrument of crime during a traffic stop on Collin Raye Drive . According to the Sevier County Sheriff’s office, Deputy Clayton Yates was on routine patrol when he observed a vehicle without license plate lights. Yates preformed a traffic stop and identified the driver as 49 year-old Michael Harlan Brown of De Queen. Brown gave the officer permission to search the vehicle and Yates found a small smoking device made of a coke can under the driver’s side seat. Brown was placed into custody and charged with possession of an instrument of crime, drug related. Can you believe these desperate ignorant morons? Believe it. Only in Sevier county.

Does no good to refuse the right to search. If you do then they bring a dog in and if he alerts then they have probable cause. They are gonna search whether you like it or not. The difference is if the dog comes in they are gonna find what you got...if you let them search they may not. I don't use drugs....hell I've never even had a speeding ticket...I also used to be a reserve officer in Oklahoma. Seeing a .22 shell gives them reasonable cause to search for a weapon, and anything else they find is free game. Also, if you are arrested for anything and/or your vehicle is towed they get to do what's called a "vehicle inventory" to account for items in the vehicle so you can't claim something that wasn't there is missing when you get it back. Any contraband found during this inventory is also free game. I don't condone drug use of any kind....or illegal activity of any kind, but I have to say our government is not and has not been by the people for the people in a long time. Same way they can toss your house with a search warrant...Tear down the door, throw stuff on the floor....destroy your property and if they find nothing oh well....though shit for you, you get to clean up the mess....Land of the Free...Ha ha.
