I suppose it required too much thought to push off the bottom with your legs and grab the edge of the pool.

Darwin says this is a frivolous lawsuit.

if she couldn't swim, then yeah, it was too much for her. it's called panic and drowning.

One would assume that the prerequisite for getting into a swimming pool is the ability to swim. Well, we know what happens when we assume.

Pushing yourself off the bottom is not swimming. See Michael Phelps.

I taught my kids how to get out of a pool when they were under two years old. If you can't figure it out, you're clearly not worth $200 million, and you should stay away from pools.

How far into the deep end did she fall? Was she drunk? Most people who fall in or are pushed are close enough to the wall to get out. If she got that panic stricken then she had no business being in the pool at all. Swimmers have a responsibility for pool safety too.

if she was in a state of panic, this may have not occurred (sp?) to her. a lot of people drown, and some of them are good swimmers; good swimmers or someone used to the water can panic also.

Statistically, most people who drown never intended to go in the water in the first place.
