Baker ran him down in broad daylight...read the testimony from the hospital staff that said Baker laughed about it in the ER and fought with the staff...read how he lied "the sun was in my eyes....it was too dark to see. I thought it was a deer....I don't drink alcohol..." Baker played chickhen that day...read how his friend Brown bragged to the first witness at Albert's torso: "Wait till ya git a load of what we got in the front seat of the car!" Baker is a murderer who will get his...God is a just God! You obviously want to ignore the facts and rationalize your friend's murder away. Do yourself a favor and stay away from losers like Baker...he's been trouble his entire life...he doesn't deserve to ever get out of prison. He has shown no REMORSE either...at least not to us. He is only upset that he got caught. When he gets out he will kill again...maybe it will be your kid.

What a friend he must be, hopefully you're kids arent't on the road when he gets out, but we are sure karma will get him before it gets to that point!! He MURDERED an innocent person, a great friend to many and son to great parents...how could you get on this site and defend such a monster and call his mother a liar. Karma. I was in the courtroom for the entire time. I know what was said and what happened. I'm not saying that Steve didn't do anything wrong and that he doesn't belong in prison cause he does. And yes he did get a slap on the wrist and that's wrong to. How ever they didn't say that he was going 130 mph. they said 70 to 75 mph. And he wasn't laughing about it in the hospital. He didn't know what was going on. I had to tell him about it the next day. And i don't care what Brown said cause he should have been charged to. you weren't there in the hospital so you can't tell other people what happened there. The nurse is so wrong in what she said. I know first hand what happened. Plus if the judge would allow Steve to have any contact with you then he would show you remorse. He was told that he couldn't contact you or your family in any way. That's why you don't see or hear anything from him.And you speak of god. Do you really believe in him? Cause I don't think that you do cause your not acting like a child of god at all. God teaches people to forgive and you can never do that.

How much forgiveness would YOU show? Suppose it was YOUR son who was minding his own business and was destroyed by Baker? Would you want Baker to be out in four years?(Try to answer truthfully -if you can.) As far as I can see, we are a LONG TIME DEAD, and so FOUR years is NOTHING. I wonder how you would feel if he was out, living his life- after killing YOUR son, and you saw him? And he was laughing, and enjoying himself, but YOUR son was dead and HE did it. You speak of forgiveness. I highly doubt that you would have a morsel of it in your heart for a creature who killed your son. Chances are, if Baker was a big old dog, and he had bitten your son, he would be put down. A dog would be put down for just biting someone, much less killing them. Baker isn't as good as a dog.

Also, to Whitestrips: speaking of forgiveness after killing someone's son is appalling. I definitely do not think that forgiveness is the word Albert's family or friends are thinking of when it comes to Baker. God may have forgiveness, really who knows, but a mother can not forgive someone for killing one of her most precious gifts, especially someone as good as Albert. Apparently you were never fortunate enough to meet him because maybe you wouldn't be so quick at dismissing the putrid man that did this, maybe you would be feeling what all of us did and what his mother and family always will. Maybe keeping your thoughts to yourself would be most appropriate.

As I was walking today with a child in a stroller on our Village streets and find this true in any town USA. I realized how little room there was for myself and that stroller and the height of the road and little space from the road white line to the edge of the road. Then the height and uneven dirt, gravel or grass. Not saying widening the roads would have prevented this. What I am saying as I was thinking about you family truly. It has been in the back of my mind for many years as I was raising my family that there were no sidewalks or walkways suitable for people, bikes, strollers that were adequate enough. I see several towns have bike paths or people paths that are away from traffic. I believe in positive energy and not anger though in your families shoes forgiveness would be difficult as I too have experiences a life altering situation in regards to a mva and not able to forgive as it effects everyone's life around. To make a long story short, I have seen many families go to legislation and officials and change laws, make laws or enforce laws. It would be a great endeavor to help build better walk ways, pathways for people and bikes or strollers. Think about walking how a person is always moving over for a motor vehicle as we feel it is too close though we are in the right and off the road. If you measure from the white line over to the edge of the pavement to the side of the road where the gravel / grass is. It's inches or a couple feet or so. Not much room for a bike or person. I know funds are limited but would it be better to use grant money or recreation and parks money for this purpose than will say another purpose not as suitable for a community. Just some thoughts. If I had the time, energy or ambition I would start this but as this time in my life I do not. I would support your efforts 150 % Just a thought that may help the hurt go away doing something to may deter tragedy's from this occurring to other families. It wasn't Albert's fault at all. It was the negligence of a driver who should have known better. That is another law that could be strengthened Thanks.

Thanks for the suggestions...something needs to be done! Unfortunately, Albert was run down on a straight-away that had an additional four or so feet of pavement within the fog line and about another foot and a half of pavement added to that. Albert was jogging four and a half to five feet ON the grass which, translates to about 8-9 feet off the fog line. Baker would have hit him no matter what. There was an additional 10-20 feet of grass on the other side of Albert. There was plenty of room for Baker. There was an open field on the other side of the road too. The speed Baker was driving did not afford Albert any place to go. Baker aimed his barretta's license plate perfectly. Thank goodness a mother walking her baby was not anywhere near Baker! If Baker didn't kill Albert, he would have killed someone further down the road. It's too bad that most drunks don't kill themselves...they just kill others. Our current laws say that if you kill someone drunk and do not have a previous DWI it is not murder...only when you have a previous DWI is it considered murder. Recognize that most people who kill when druck have already driven drunk...some reports indicate as many as 90 times. Killing someone is how they get caught driving drunk. Please recognize too, that if Baker was driving the speed limit, Albert might still be living. Please check out the research on pedestrians and dismemberment from a speeding vehicle. Baker was driving with a suspended license for speeding when he murdered Albert. The law should consider that someone with a licensed suspended for speeding who kills someone when speeding clearly is murder. For it to be considered murder the law requires the previous DWI to prove a "depraved indifference to human life" to justify the murder charge. We are trying desperately to change these laws. We also want NY to change its laws concerning unethical judges. Our state does not allow these judges to be voted out of office as some states allow. When a judge in NY is elected for 10 years, we are stuck with them forever. The judge we had ran unopposed too. It is easier to get rid of a tenured professor than a pathetic judge. Recently, the judge we had ran for NYS Supreme Court. Forunately, he lost. Many voted for him because they wanted to get him out of our local community. This is a frightening commentary on the quality of this judge. Thank you for your insight and suuport. If we continue to use our voices, we can change our laws for the better.

You are WRONG again! Obviously, you are not very bright nor are you a good listener. In court they did throw around the 70-78 mph speed but that was the LOW RANGE of speed. The high range was not allowed to be heard during the trial! Please when you run your mouth, PLEASE check your facts!!!!! You are correct, however. Baker was not going over 130mph at the point of impact. The report demonstrated that he slowed down prior to impact. Why did he slow down if he never saw Albert anyway?
Concerning the ER, maybe your Steven's behavior changed once you arrived to hold his hand. The testimony from the hospital nurses and staff consistently testified that your friend was a total ass...as was his friend Brown.
How dare you judge my faith! If I was not a woman of faith I would have killed Baker by now. God's law says that we must obey the law of the land first...although His law clearly states: "an eye for an eye." It's not up to me to forgive Baker. That's God's job. If your Steven is so wonderful, please ask me why he didn't just plead guilty? No, Baker wanted to get off easy!!! He didn't care how much HIS murder and HIS trial hurt my family. My husband suffered his first heart attack the first day he had to sit in the court with Baker. We suffered enough losing our precious ALbert, having to suffer through those hearings and trials punished us more than Baker. If he cared, he would have told the truth. He would confess that Brown told him to run down Albert. He would confess that he saw Albert. If he was sorry, he would have spared us the pain of the courtroom. If he was sorry, he can tell the court he will serve his complete sentence so we don't have to drive down Albany to persuade the parole board that Baker should stay in jail. We won't need to collect letters. If he cared, he can pay off Albert's college loans. He can pay for Albert's funeral. He can pay for a bench for Albert's father so he can sit when he visits Albert's grave. He CAN do A TON of things. All he needs to do is contact us....I will give him a bunch of things to do to prove his remorse.
I don't buy the "his lawyer told him not to talk to us" crap. There is never an excuse not to do the right thing. Since when does Baker do what the law says anyway? Baker is only interested in protecting his fat bottom. He doesn't care that he took a life. He doesn't care about our family at all. Please don't insult me with your insanity and stupidity.
If you want to help, get Baker to tell the truth about what really happened that day. Force him to admit that he saw Albert and was playing chicken with Albert. The court already promised him that he would not serve any penalty for telling the truth of what happened that day. He and Brown played chicken. If he admitted the truth maybe we could help other families in our situation. The truth would help us have some closure if that's possible. The truth would help us change the laws.
Please know that you don't have to hide behide this blog. Please contact me directly if you sincerely want to improve this ugly situation. I would love to believe Baker is not some monster. I would love to help Baker change his life. I would love the laws to change. I don't want my baby's murder to be a total waste. I don't want Baker to kill again. I'm very sorry for your loss. White stripes told me about this blog and I read everything and I'm truly sorry about what he wrote to you. He had no right saying those things and I told him to stop. I want you to know that not everybody that was there sitting behind Steve in that court room agrees with him. What he did was wrong and he should have gotten a longer term in prison. That appeal was a joke. I am the mother of his daughter and i am truly sorry. I'm not with Steve anymore cause i cant pretend that he didn't do anything wrong anymore so now I'm the bad guy in his eyes. I have told my daughter where her daddy is and why hes there. She knows that her daddy put himself there and that he did something very wrong. She is 6 years old now and can understand more about it and I have to tell her the truth about things every time that she comes back from seeing him. I have told him awhile ago that I will never let him drive her anywhere when he gets out and if he can drive again. I can't trust him to keep her safe and she understands that too. So once again I am very sorry for your lost and for white stripes comments to you.
