Without knowing who's the responsible party for this particular tree, it is common to see large trees that are not being maintained on people's properties. It is a homeowner's responsibility, expensive as it is, to check that roots are not rotting and to regularly trim dead limbs. It won't prevent every accident but anyone with trees needs to take care of them - trim ivy that is choking them, inspect for carpenter ant damage, and cut them down (yes, even us tree lovers know we have to do that sometimes) if they are leaning at a dangerous angle or have other problems. Again, can't say for sure that was the case here but it's something all property owners should do regardless. And of course trees on public lands need to be inspected by the responsible parties.

There is definintely someone responsible for the collapse of that tree. Weather it be the homeowner or the state, I hope that the Machicado family wins their lawsuit. Those poor people.
Incidentally, Newsday says it was a "pin" tree, I think it was probably a pine tree. And, Sheila is 16, not 18 and David is 18, not 16.
