Judged: 2 2 2 Very good point many chain restuarants such as McDonalds I have not seen smoking in them for one long time they are grab and goes with little time for a smoke and reason to. Many of them are drive through with smokers in the cars anyways. There are complaints of cars idleing in the lines causing pollution though some places also have a 5 minute idle law plus fine. Yes Jeroma the article is pointless like so many on Topix but they get paid to feed their B.S. to the public something that should be banned. |

McDonald’s Corporation (1993),9 plaintiffs brought an action in federal court in Connecticut under the American with Disabilities Act, arguing that the presence of tobacco smoke in the defendant’s restaurants prevents the plaintiffs from having the opportunity to benefit from the defendant’s goods and services. The plaintiffs, all of whom have adverse reactions when in the presence of smoke, also allege that the defendant’s restaurants are places of public accommodation under 42 U.S.C. 12181. They sought an injunction against smoking in the defendant’s restaurants,“thereby giving the plaintiffs equal access to said restaurants”. However, a district court judge dismissed the case. "On 4 April 1995, the US Court of Appeals for the Second Circuit reversed the judgments of the district court, ruling that “we find that plaintiffs’ complaints do on their face state a cognizable claim against the defendants under the Americans with Disabilities Act”. The court noted:“the determination of whether a particular modification is ‘reasonable’ involves a fact-specific, case-by-case inquiry that considers, among other factors, the effectiveness of the modification in light of the disability in question and the cost to the organization that would implement it... Judged: 2 2 2 OSHA standard for indoor air quality for respirable particulate (not otherwise specified) for nuisance dusts and smoke. That standard is 5000 ug/m3 on a time-weighted average (8 hours a day, 5 days a week) and is intended to be protective of health over an average working life of 30 years! Field studies of environmental tobacco smoke indicate that under normal conditions, the components in tobacco smoke are diluted below existing Permissible Exposure Levels (PELS.) as referenced in the Air Contaminant Standard (29 CFR 1910.1000)...It would be very rare to find a workplace with so much smoking that any individual PEL would be exceeded." -Letter From Greg Watchman, Acting Sec'y, OSHA The evidence is sufficient to infer a causal relationship between secondhand smoke exposure and odor annoyance. If you actually read the surgeon generals report it used mostly "The evidence is suggestive but not sufficient to infer a causal relationship" and even then if you read page 21 they admit that the use of meta-analysis on observational studies is not a widely accepted and controversial practice and yet they do it anyway. Accomodation for non-smokers were made it was called non-smoking sections.........prohibition isnt a cure its an agenda! |

Judged: 1 1 1 Fun how the "experts" can come up with such a rapid conclusion so quickly in certain cases. While if it is about putting down a pipe-line that coluld create 50K well paying jobs, the "environmental impact" studies need to be studied first by making studies over those by students studying to get another PhD and then walk into a push university job. hmmmm, another example of government manuifacturing consensus and showing it down the sheeple's throat. Unfortunatwly, wayyy to many fools swallowed this bait in order to stick it to the smokers. This time it was smoking, next time..... We will see.
