Officer accused of perjury- Security footage refutes DUI allegation by C. Benjamin Ford | Staff writer A Montgomery County Police officer who is being investigated for criminal perjury remains on duty with no restrictions, police officials said Tuesday. "We do treat these allegations seriously. We have to let this process take place," Lt. Paul Starks, a police spokesman, said. Officer II Dina Hoffman testified in April that she arrested a Rockville man for driving under the influence behind the wheel of a parked car. A recording from a security camera showed the man was lying down in the back seat, with his feet out the open passenger side door, when she approached him. George Zaliev, 56, of Rockville, was arrested about 7:30 p.m. May 3, 2008, for DUI at the parking lot of Sarkissian Interiors at 8537 Atlas Drive in Gaithersburg. Police said a preliminary breath test showed a blood alcohol content of 0.15, nearly twice the legal limit. At his Montgomery County District Court trial, Hoffman testified 11 times that she found Zaliev in the front driver's seat. She said she shook him awake and he was not cooperative in doing field sobriety tests. Zaliev's attorney, Paul E. Mack of Columbia, used a laptop computer to show a video from a security camera at Sarkissian that recorded the arrest. The footage, reviewed by The Gazette, shows Hoffman arrived and immediately walked up to Zaliev as he was lying in the back seat. After Judge Dennis A. McHugh viewed the tape, he ruled the arrest lacked probable cause. The judge found Zaliev not guilty. "I've done enough of these that I know, without the video, it would have been my client's word against the officer's and I probably wouldn't have won," Mack said in an interview. NEGATIVE sir, as there are people in all careers that abuse their positions in one way or another, Not everyone is that way. I agree an example should be made, but don't judge every Officer based on asshole actions of others! One may loose their life trying to save yours! |

The Montgomery County police officer produce the Maryland vehicle law book to prove it. But police acknowledge the law is a bit fuzzy. "A judge is the one who makes a ruling on whether it's appropriate or inappropriate," said Montgomery County police Corporal Stephen Galloza. In a hearing on Tuesday, a judge dismissed Zaid's ticket and all other citations issued in that zone when the officer did not appear. Police said the officer's on military leave. Zaid, who represents government whistle-blowers, says he's still not satisfied. He says he did nothing illegal and if police don't apologize he will sue. "I want an apology," Zaid said. "I had to waste my time." Montgomery County police say enforcing the ban on flashing is up to the individual officer's discretion. __________ And how many drinks the officer had during his meal break or before reporting for duty. It would be nice if maybe the MCP would actually enforce written law and not their interpretations. Just another example of an unsupervised constablry. Police apologize after officer lends ticket book to driver Tow-truck operator issued tickets in Gaithersburg by Sebastian Montes | Staff Writer Excerpts From Article- Montgomery County Police are voiding parking tickets and apologizing to residents of the Fernshire Farms neighborhood in Gaithersburg after a four-year officer gave her book of parking tickets to a tow-truck driver who issued them last month. Residents who received tickets say the tow-truck driver identified himself as a police officer working on behalf of their homeowners association. After a private meeting of the HOA, residents who attended said police told them the tow truck driver has been fired and the police officer has tendered her resignation. After an internal investigation,... -the officer and tow-truck driver are not expected to face criminal charges- ..., he said. On Tuesday, police spokesman Cpl. Stephen Galloza confirmed that the officer was Jennifer Phoenix, a four-year county officer at the 6th District station in Gaithersburg. She could not be reached. After The Gazette expressed interest in attending Monday's meeting, the HOA board closed the meeting to non-homeowners on "advice from counsel and property management," Seeger said. Several residents leaving the meeting said that police told them that the officer had submitted her resignation, effective July 5. Galloza declined to discuss personnel matters Tuesday. Phoenix is one of four county officers named in a $6.4 million civil lawsuit filed in federal court by a Montgomery Village woman, who alleges that the officers beat, kicked and stunned her with Tasers in her living room in 2006 after she had been handcuffed. Obviously you have not been a cop for long or your just a squirrel. I have known this officer for over 30 years. From when he was a rookie in Wheaton to when he helped clean up the Piney Branch/ Flower Ave area in the mid 80's. And now he works the Buisness district of Wheaton Plaza. He has assisted the county with 1000's YES 1000's of hispanic assist calls and disputes for other officers. Now does this excuse him for what he did that Friday morning on I270...NO. But I would at least expect from you and ALL officers of the department some support for him and Distel. God forbid you radio in a 10-50 they would be there for you. STOP all the BS!!!! Like I said, his actions were extremely unnacceptable and will be dealt with accordingly. He is one of the most highly decorated officers in the department. You had made some good points on "You don't shit where you eat" and I agree. But you also have to remember that this job...correction CAREER comes with many obsticles and difficulties. Over his 33years in the department I am sure he has seen just about everything a COP could see in their lifetime, as I am sure you have as well. NO COP is above the law. Unfortunately there are some, maybe you, YES I am calling on you. Can you be honest with all of this and say that you have obeyed the speed limit on I270. Whats the difference if it's DUI or speeding, both are illegal and both could potentially kill. As an officer of the law I would expect you to realize this and come to your senses. I am in no way trying to bash on you for anothers fault but come on and think what you are doing. Just remember when a 10-50 occurs and you need assistance.... As for the idiot (just for shits and giggles) MoCo stopped wearing "Brown uniforms" almost 2 years ago. Not that it matters!!!! maybe soo.. but he needs to be relieved of his duty.. a police officers JOB is to enforce the law.. is it fair to have a judge on drugs sentencing people who do the very same thing? regular people's jobs arent to enforce the law.. we have jobs that have nothing to do with the law.. police officers KNOW the law.. THEY KNOW IT WELL!! they have no excuse for drinking and driving... if they have an alcohol problem and they keep it away from the job then yes all they need is rehab.. that cop should lose his job and all other pigs that break the laws.. its funny.. you want us to have cops who cant enforce the law themselves to be enforcing it on the public? lol your funny
