Suspect named in Wilbarger County homicide

i would like to know what is going on in this case..

Toby was in self defense mode, she had every intension of killing him when they met that night. She was no angel in this case, she went for him, and he paniced, He wrote a letter to my husband, saying "it was her or me bro" there are alot more details in the case, but I can't explain here.

What happened is that Toby Armstrong got 45 years in prison and will die there. Thank goodness.

And this relative of his that is saying he is innocent is nuts. "It was her or me"? That is ridiculous.

Let me ask you something April, if someone tried to kill you, what would you do? Bingo, you would go directly to the police station and say, "Oh my god, this person tried to kill me and I had to defend myself. I am so scared, this was terrible."

What did Toby do? He went over to a friends house and drank some beer. Then he lied to the police on several occassions and told them he knew nothing about what happened to Rose Mary. THEN, a few days after the murder he comes up with this self defense thing.

Yeah, that is REAL believable. Well, I guess it is if you aren't very smart.

ok, so I’m not saying it was not a brutal murder, and that he is innocent, apparently he was not, or he would not be spending 45 behind bars. But let me ask you a question, if Rose Mary had the crap beat out of you ( cause that’s where the bruises came from, over a money/drug dealgone bad, is what I hear anyhow) 2 weeks prior to the murder, wouldn't you want meet up with her? I would, but not by myself in dark oil field, especially as a woman I mean what woman would unless she was armed, or ready to put up a fight, or maybe had other intensions (perhaps murder herself) So they meet up, words are exchanged, there is a struggle ( we will just say that he started the struggle to appease everyone) Someone stated that Rose Mary was not a small person, said she could, "hold her own" Toby being a small guy, weighing about 160, we'll call the match about even, but with Toby the man, having a little advantage, yes.
No one really knows what happened, who attacked who and how it all really went down, regardless, Toby had/got a knife, if he brought it or not, who knows. Regardless, he got it. Keep in mind that, depending on her intensions and actions, Toby most likely based his off of hers and vice versa. Also, keep in mind that he does not have a criminal record, so going out there with the upmost intent to kill is not likely, but whoever was armed was smart!! There is no way; I would meet someone in an oil field unarmed.(man or woman ) Ok so the struggle begins, Toby gets the upper hand (knowing that this woman is dangerous considering she just had you nearly beaten to death 2 weeks prior) he stabs her 15 times. But who’s is to say that considering the circumstances that you might not panic and stab someone before they stab you? I know that if a knife is pulled in a fight, you are being stabbed, maybe not 15 times, but I will make sure you don’t get up! Toby went ballistic yes, but again, who is to say that you wouldn’t in the moment. Most of us are not capable of murder, but in the heat of a struggle who wouldn’t if they were threatened? What real reason would Toby have to kill her unless he was threatened with his life?
Ok, so you have just killed someone…what would you do? Well you say that you would go to the police….but really if this woman has so many people on her side, and you still feared for your life, even after she was dead, what would you do? Join a witness protection program?? NOOOO, you might want to hide for a bit, disappear, go have a beer and think?? I might even go get plastered with my buddy, enjoy my last few days as a free person, because I know I’m screwed!(Post continues below)

So a few days later you’re being interrogated, all fingers are pointing to you, your busted!! Reality has set in and you have stabbed someone in the throat 15 times, boy this looks bad! But you have a defense, it was defense, you want a trial. Well again you have killed someone in an oil field, but you didn’t just kill them, you went ballistic!!! You didn’t go to police, you tried to cover your tracks in fear of you and your family’s life. The court offers you 25 year plea bargain, no way, you have a defense. The court comes back and says they have enough evidence that if you go to trial a jury will sentence you to life. What? That’s crazy! What to do, go before a jury and let them sentence your faith or take a chance that you might be offered a different deal? Someone is going down for this, a woman was murdered, she is dead and I am alive...looks really bad, oh crap! Um yeah, 45 years sounds better to me. The odds are stacked against you anyhow…besides if they let you out, you will probably be killed anyhow.
Point is yes he is guilty, I guess. And Rose Mary is dead, the damage is done and he serving his time for what he has done, but until you completely understand the situation, you can not judge, yes you can give your opinion and say he is a piece of crap and hope he rots in hell all you want, but again who are you to make that call? RIP Rose Mary.

you know what april,you need to get your facts straight for one,he got his ass beat at a party. two he didnt have to kill her,he knew what he was going to do,thats why he did rob her left her there,and went on a spending spree. He should have never been able to plea bargain,it should have be the death pently for his sorry ass,but that's ok he'll get his when he meets his maker.
