Live Oak mom fights for disabled son's rights

The last thing Live Oak resident Robin Benites expected last week was for her attorney not to show up when she appeared in court to plead her case against Bay Federal Credit Union for repossessing and selling the modified van she used to transport her disabled son.

This story is sickening.

The lawyer needs to be sued for malpractice (that alone should pay for the van outright).

Bay Federal needs to step up and lend a little humanity to the situation (now that they know what's going on).

Here's a story of a family doing everything they can to take care of their own and they can't get a break. I just wish we could get our humanity back. We've seen it - especially in our community - I guess sometimes we just get lost.

I hope this article gets them the attention they need and they are able to get the situation corrected soon.

How could the tow company even go through with it? Lets' get back to common sense humanity.

And before all you negatives begin with your negative talk know that disabled people have a legal right to have their needs met.

The alternative to keeping disabled kids at home is to put them in a state paid institution. As a society we need to do everything we can to keep kids with their families.

I agree with LiveOakRocks. Bay Federal's rep, which they have worked hard to build up in our community, will be tarnished if they don't get this family's van back. It obliviously cannot be done without.

You know, life is hard enough without having to try and put up with cr** like this. Hang in there folks.

So what's the story here? That Sam Maverick is an incompetent attorney? This is very very sad. I hope the community and BayFed can help make it right. And if Sam Maverick is indeed as bad a lawyer as this article makes him out to be, then he should be disbarred STAT.

I feel so bad for this family, I hope Bay Federal can get their van back for them. I would fire the attorney, sue him and look for a new one. I also hope San ANdres Regional can help the family out. Maybe the family can look into getting respite care through Easter Seals and the respite Care person can take her son to school, to help the mom out.
The family is in my thoughts and prayers.

We as a community should help this family! We can right comments all day long but it's not going to help this family. We should start a fund or call the school that can't pick him up. I would advise the mom to start home schooling her son while they are getting this situated.

This country is turning into a Third World mess right in front of our very eyes.This mess was created by Republican greed, and ill conceived economic policies of the Bush admin.I'd like to hear his explanations now costly wars, and lack of govt regulation of the financial industry is to blame.I want to vomit every time I read a current Cheney interview...these guys accept no responsibility for our situation.Recovery...my A$$!...and I'm tired of everyone blaming Obama for inheriting this mess.
This thing is going to get a lot heavier too. I'm bracing myself to go into emergency community service mode, kind of like after the quake...look over the fence, do the neighbors need help with food or clothes.America had its day in the sun....now the long, cold winter will balance that false prosperity. If the world continues to lose faith in our system and policies...then loss of faith in the US Dollar as the international standard currency is soon to follow....then you'll see inflation like you never dreamed.We won't fix this one by running the money presses overtime.

Psst - there hasn't been a Republican in charge of anything in California, much less Santa Cruz. Get a grip. In the Third World, the $14K of other people's money spent modifying the van would send a dozen or more kids to school for a year.

Here is where we can get the money: US foreign aid! Time for our country to say up yours to the rest of the world and start investing at home. I am so sick of us giving to other countries only for them to defecate on us in return. Let China give them money.
And Israel? Maybe it is time for them to learn to get along with their neighbors.

I think we can contribute to an established fund at Bay Fed, they can work on getting the van back, and in the meantime, once it is returned, we will have contributed what she needs for the van. If Bay Fed fails in this, I am pulling all my accounts with them. If they fail, we will have established enough to help her get another vehicle. Shame on Bay Fed.

So then you have no idea about the repo market. That's why banks foreclose, too, so they can sell the house for more than the value of the loan... Repo is a stop-loss activity, not a money maker.
