Am I the only one who sees something wrong with this story? Why wasn't the driver cited? I know all turned out well, but that strikes me as peculiar, especially for Vacaville PD. Now, if it had been a teen driving? Or...

25 MPH is too fast in that neighborhood on that narrow street with parked cars on both sides.
No emjoe the article doesn't state the race of the pedestrian or of the driver of the vehicle. Somehow that always seems important to you.

The idiot kid ran out into the street. The driver, obeying the speed limit, is not at fault at all...even though the parents of the idiot kid will sue...and win.

I agree with emjoe. Drivers shouldn't be held accountable for people, in this case kids, running in front of your car. If the driver was gong over the speed limit then I would say he is at fault, but that does not seem to be the case. I used to live on berryessa and Marshal and I would never let my kids play out front because of the people speeding down cemetery hill and because of the weirdos in that area.

In accordance with the law, the driver is at fault, regardless of the circumstances. The pedestrian always has the right of way. I'm on the side of the driver, here; I'm just wondering why he was not cited.

The kid was lucky the driver had good enough reflex's to hit the breaks and slow down enough to save the kids life.

As a matter of fact since the driver was not charged, the kids family may have to pay for damages to the vehicle if there is any. As long as the driver proves A. The person was jaywalking, B . He was driving the speed limit, and C. He could not stop in time

I once hit a youngster who darted in front of my car as I was pulling out of a parallel parking space. It was just a tap. I was absolutely horrified. I got out of my car and walked the boy over to his mother. I'll never forget that.

Conditions like being in a residential area with children. I drive 10 to 15 mph under those conditions. Children don't have a sense of fear and focus on themselves neglecting their surroundings. Drivers need to be aware of their surroundings at all times.
