That problem arises because the Perretta Towers is, apparently, a Federally funded facility for seniors and the disabled. Mr. Herbowy may have been concerned that the press availability turned a perfectly acceptable meet-and-greet into a campaign event, something banned from Federal properties. I'd like to point out again that I don't particularly like Mr. Herbowy because of his involvement in the disastrous HOPE VI program. That said, if he was objecting to Mr. Lamb using the site for a campaign event it was a valid concern. |

You don't know the law. Read this and the million other rulings showing a constitutional right to campaign at public housing units. I believe you missed my comment that meet-and-greets are perfectly acceptable. If you look at the video Herbowy clearly says "You're welcome to visit like a citizen" at the :46 mark. Immediately afterward Mr. Vescera appears to be discussing the problematic placement of news cameras, presumably for a press conference in the front of the building. It's the news conference, not the visit itself, that Herbowy is clearly objecting to. If Mr. Lamb's suit consists of "I wasn't allowed to have a campaign press conference on federal property" I think we'll see it resolved rather quickly. What makes this personally amusing is that I happen to like Mr. Vescera and absolutely loath Mr. Herbowy. In this case, however, it appears Mr. Herbowy was in the right. |

Only in Utica would people actually believe this to be wrong. It's as American as apple pie. Remember Dr. King's "I Have a Dream" speech at the Lincoln Memorial? Or how about Glen Beck's "paid" event held there? It's America! |

But they don't hold campaign events. Is the difference really that hard to understand? There's a dodgy area where incumbents can hold events connected to their "official duties", but even those are pretty tightly controlled. Were either of them running for office? More tellingly, Mr. Lamb knows the rules and chose to ignore them. He's worked in a congressional office for over a decade. Why would he believe that the rules don't apply to him? There's a secondary issue that actually makes this an interesting case if Mr. Lamb moves forward with his lawsuit. As a HUD facility specifically designated for the disabled access to the Towers could run afoul of HIPAA. I'd be interested in seeing the ramifications of that. |

Read the court case I posted. And many, many candidates have announced their candidacy in federal buildings and sites. Jon Huntsman and Ronald Reagan both held their announcements in the same Federal Park, with massive media coverage. Maybe you don't believe in the constitution or you subscribe to the gestapo tactics used around here. I don't know. But all of that aside, Herbowy's attitude was terrible and a huge embarrassment to this city. It was terrible and Mr. Lamb, who I don't even know, handled himself like a gentleman. The camera Vescera was referring to was the campaign manager's personal camera. The media showed up on their own because they get the candidate's schedule. That's how a campaign works. The campaign releases their daily schedule when visiting a city or town so that the media may cover the candidate and interview him/her. This isn't rocket science. |

ADA compliance has nothing to do with it. It's a federally funded facility specifically designated to service a protected class. Hence my interest in seeing Mr. Lamb's alleged lawsuit move forward. It's an interesting point of law that hasn't been explored up to this point. Then why didn't he just walk ten feet to the sidewalk and hold the press availability there? Both Mr. Lamb and Mr. Morosi have served as congressional press representatives for years. They're intimately familiar with the use of public spaces for campaign events. Surely you're not accusing them of incompetence. If they had been willing to walk a few paces to a public sidewalk there wouldn't have been a confrontation. |

If you understood what happened, you'd know they were not holding a press conference. They were doing a meet and greet and the media happened to be there. There was nothing to be held in front of the building. They were simply going to meet voters and the media showed up to follow along. And the building is NOT designated only for the handicapped. I have an aunt who lives there that is in better shape than me, and she's in her mid 70's. |

So the whole confrontation wasn't about Mr. Lamb meeting with people. It was about his desire to get press coverage of said meeting. If he wanted to talk with the press why was it so hard to just walk five steps to the sidewalk? But the building is specifically designated by HUD to meet the special needs of the disabled, a clearly protected class under HIPAA. That it isn't dedicated solely to their care is irrelevant. This whole affair looks increasingly like an attempt to stage manage coverage that went awry. If Mr. Lamb truly wanted to meet with the public he would be publicizing these events, something notably lacking from his campaign website. It would appear that this listening tour isn't actually about "listening" to the public, since that would require open meetings announced ahead of time. The actual concern seems to be carefully stage-managed appearances that purposefully avoid the public and instead strive for a pre-selected audience. Of course, I could be completely wrong. If so, could you point me toward the section of his website where the public meeting schedule for this "listening tour" is? As a stakeholder in Medicare I would love to hear his thoughts in an open forum. More importantly, I'd like to contribute to his stated desire to hear mine. |
