The city of Ukiah will let you use this defense depending on who you are. In 1999 Gary Bruchler only recieved just over one year for brutally using a hatchet to hit and kill his own son,John William Bruchler while his son was asleep!!

I feel overly compelled in replyig to a Father that would committ the mortal sin of actually killing his own Son. First of all I must ask myself the question, when does a Father kill his son? There is no answer other than NEVER; no matter how upset a Father feels towards his Son. An act such as this could only be conducted from nothing short of pure evilness. Fathers do not kill their Sons !!!!!!!!!! So far as the Judicial System you spoke of regarding the "Good Ole Boy," I have seen unjust sentences handed down from juries before, but never when it involves such a horrific crime such as you have described. Allowing the guilty to walk on an assault or even a DUIL is wrong, but allowing a Father to basically walk on what you have described is a complete miscarriage of justice. This was most certain well planned and pre-mediated. I searched and posted the legal defination of premediating and it most certainly fits what you have described.
First-degree murder is the most serious form of murder. In most states, it is categorized as "deliberate" - that is, the defendant made a clear-headed decision to kill the victim; "premeditated" - the defendant actually thought about the killing before it occurred (the period for this can be very brief

Premeditated, how could anyone think anything else. Seems he had plenty of time to contemplate what horrible act he was about to do.I DO THINK HE thought of EXACTLY what he was going to do. It was not an act of self defense. John was asleep on the living room floor. His blood is still in the wood of the floor unless the floor was replaced.

It sounds as if the father had been thinking about it for awhile. You don't just suddenly decide to kill our own child. He was to afraid to do it while his son was awake. He might get hurt,he jumped on the opportunity when he seen his son sleeping. I would like to take a moment to thank Aunt Sharon for kindly commenting that John Bruchler's killer, Gary Bruchler possibly premeditated the killing of his own son. It is refreshing to some of John's family members to finally hear someone not rip John apart and not uphold the sick person that took his life. John would have loved you as a friend....Aunt Sharon. I would also like to add our sorrow regarding the death that You are having to daily contend with. People that have never lost a loved one, due to the wicked hands of another, do not know what they are saying when they speak of that day of closure; there is no such day. We know this because in addition to the loss of our beloved Cousin John, we also lost our oldest son at the hands of a killer that was never found. There is no such thing as closure when some person comes along and kills someone that is literally like a part of your own body to you. So to those who support killers of any type, I pray that they never scope in and take someone that you love dearly; there is no healing and the pain is beyond explaination. I again pray that this does not ever happen to any of you folks.
God Bless you Aunt Sharon

Oh my dear Lord, thank you for the kind words. I feel so much sorrow for you my heart is breaking. I'm sure I would have liked John. I told my Sister(Jimmy's Mom) the only thing that can be worse is never being able to find out who the killer is. To have two such hedious crimes happen to one family is to much to bare. You must be some really strong people. You are right about closure. I have always thought that word was stupid. There can never be closure for someone you love. When I go to church tomarrow I will pray for you and yours. I will ask the congregation as a whole to pray for you also. God Bless. John was passed out from being so messed up on alcohol. This was after he treatoned to kill Gary (dad) and his mother. This act was the conclusion to tons of abuse from John over the years. Gary tried to help his son many times over the years, to no avail. Gary and his wife felt truely threatened that fatefull day. Gary lives with this today and every day. There is no good thoughts about this crime. I would have done the same thing or something to that effect if I was in that situation. The jury understood and made the right decision.

As for the story I heard John had tormented his family Mother, Father and sister for years. He was portrayed as a psycho druggie who physically abused his entire family. You must remember a jury can only rely on the facts presented to them it sounds like the DA on this case wasn't on top of the situation. Murderers get appeals but victims just have to take what they get unfair but true. I am so sorry for your loss and pray that true justice will be served at the hand of God.

Thank you Jimmy's Mom. NO one knows the true story of John Buchler, and you, "true to life" you know nothing. I am truely appalled that you in Ukiah condone murder of another human being when the police could have been called. But no Gary Bruchler chose to premeditate the murder of his own SON!!! He walked out of the living room through the dining rooom into the kitchen out through his garage. Then he had to unlock his storage/workroom,find the camping hatchet ,return through this same route back to the living room and nearly hack off the head of his sleeping SON!! How can anyone with a pinch of brain matter call this involuntary manslaughter? How was John a direct threat at that moment when he was asleep? Ever hear of CALLING THE POLICE? Gary had plenty of time to call the police and have John removed. He left the house and chose to return to do the dirty deed with the hathet. I have many times seen Gary be the mean and cuel person he is to his family when they were young children. This other side of himself he cunningly hid from the public. He was not the "good ole boy he tried to portray. JOhn told me many secrets about his parents that never came out at the trial. I was threatened by a family member if I came to the trial I would live or not live if I came and be very sorry. This family has a long history of secrets and heinous past events. So YOU who know nothing should say nothing. Gary Brucler WAS a cruel mean person. I doubt JOhn Bruchler his Son, who is dead in the grave and has no voice would agree that he had no right to life. Gary Bruchler "ole girlymare' himself will face GOD!!!! All the thngs Gary used at his trial was said in the aftermath. I know John would have told a different story. I know for a fact his younger years in he Bruchler household was no picnic. So quit condoning murder. Get a grip,no one has the right to take the law into their own hands not even your god Gary Bruchler

In response to the person ("True to LIfe), it sounds like you fit more into "True to Death." I am sorry to hear that there is another person out there that would be willing to kill his own Son, rather than leave the house, and go to the police station, as lawfully required. There is no statute that allows the killing of a person who scares you by some comment they may have made. You admit that there were threats made towards the family by John; where are the police reports supporting this. The common citizen always notifies the police when they are threatened, they do not become the judge, find the person guilty and carry out a death sentence all on their own. There is a due, legal process for these types of situations and the common citizen follows the legal requirements and do not kill the alledged threat and then report past claims of threats for the purpose of their defense and justification that supports their taking the law into their own hands. It makes me feel very suspicious that people in such fear and under such a long period of threats did not take the time in notifying the local police and filing one single compaint; they shared that only after the death of John Bruchler. I have seen killers try this before, but the system did not buy it and told them the exact information I have pointed out.

I know the whole family, witnessed the abuse by John, the police were called many times! DOn't you think that if there were any other way, the mom and sister would not be standing by Gary's side? You know nothing McLeod, go find another loser to peddle your drugs to, Better Yet, come to Ukiah and grow a garden, I would love to see your mug shot on MCSO booking log....freakin' druggie!

Anytime someone resorts to insults in a debate they have just suffered a resounding defeat. And yes it does sound just like a Bruchler family member we are talking to. They all love to be insulting. And all they can talk about is drugs, drugs, drugs, drugs. Makes you wonder just what are THEy up to huh?

Not related at all, just know the whole family and what they went through, His sister had been abused by him more than once and the police were called, it surprises me not that there were no reports! How many times has someone been killed only to find out that the law didn't take action many times before the violent act! They always tell you they can't do anything You sound like an angry dealer who lost his income stream from a hostile violent criminal named John Bruchler! I never said he should have been killed, did I? Nope. You were not there, you didn't live it, you were not abused so YOU can't sit in judgement of Gary, nor can I, he was tried by a jury of his peers and was given the sentence that was deemed appropriate by said peers. That is our justice system. It is the same one that allows drug dealing people like you walk our streets, it ain't perfect but it is the best one in the world!
