This is the most ridiculous defense since twinkies. If the man had truly been impaired, he would have displyed symptoms. Unless he spent half an hour in the fridge and left it 3 minutes before the impact, he's faking. Dry ice is carbon dioxide, not carbon monoxide. CO2 will give you skin flush and some shakes, maybe a rapid heart beat. These resolve quickly with exposure to room air. The defense is trying to confuse this with carbon monoxide, which is deadly, and binds with the hemoglobin in the blood. Its an asphyxiant, and CO poisoning is characterized by head ache in the early stages. I hope the DA is good, and this guy who has killed before, goes to jail for the rest of his life. I hear they don't use dry ice for anything at San Quentin.
