I do believe that the police messed this one up! You don't skip steps in any case! Good luck because I think you are going to need it! This is already a tragedy and the loss of that confession evidence would be even more tragic! Come on after all these can't you get it right yet?

You have nothing to say just anonter vermonter! Why don't you exercise your chance to stay on topic and say something about the original subject Supreme Court considers Christmas confession? Real Vermonter bashing has been going on for quite some time now and it has no effect so why waste your time on me when you could possibly be making a difference by posting on the subject? what a joke!!!!!!! to many witnesses seen this crime enuff of wasting the taxpayers money, convict him, when i was 15 yrs old public defender KATE HAYES said to me "the police not informing you of your maranda rights has no direct bearing on your charges, you know your guilty, stop wasting my time""

so should i go to the supreme court and have my conviction lifted????

Does anyone realize how much taxpayer money we're wasting on this stuff? The guy did it. What a joke our criminal justice system is. They waste our taxes on things like this, and then kick criminals lose to re-offend innocent people under the guise of saving money. Judges have been on a pedestal too long and have lost touch with reality.

Christmas Believed Wilkes was going to ruin his life because of alleged child molesting of Wilkes children. So he road his bicycle past Wilkes and shot him in front of the kids.

Even if Christmas confession was legal there still would be a trial so it really means nothing.

This is my take on the situation. I could be wrong or left out a fact.

You got to cross all the "T"s and dot all the "i"s - otherwise - it's grounds for appeals or overturn of a conviction which would csot more money. However - since that new DA has been in office she seems to be taking alot of cases to the VT Supreme court and most recently - US Supreme Court. I think she is just building her resume -really people. She could have let this go - and still got a conviction. Period. Because if the St Supreme Court doesn't give her the right answer - she will be using more of our money to go to the US Supreme Court. We have got to vote this lady out at the next election. I wonder what the budget looks like for the Bennington's DA office? Just what are we forking out to further her career?
Some of these charges she comes up with are crazy? She and the people she manages would rather go to trial than plea the charges. Normally - that would be great because that is what the guy "wright" used to do a lot and why I voted for this one we got now. But - now she has to go.

In response to rachellyn and OMG1, the reason there are so many conflicting stories is because of people like OMG1 who heard a story and decided to tell it again before the facts have actually been proven.I don't think anyone really knows the truth except for Mike Christmas who is in jail and will be for a very long time. Even after he gets his day in court, The whole truth will still only be known by him so why not let the children involved live without all the speculation, just wait for the facts and then you can only believe half of what you see and none of what you hear.
