No storm in the forcast. For all intents and purposes DVCA is a dead organization, having no power, lacking the money or the ability to enforce anything and now a board consisting of 1 person Gary E. Lowe (everyone else having abandoned him including Matt Brown). That leaves him in a position to continue to collect money from the people who are ignorant enough to send it in and pocket it for his "loans" made to DVCA!
One footnote Mr. Miller won the default motion in his damage suit against Joe Dodson for the first false arrest, now it is a matter of wait and see what happens with the second attempt to file false charges.

Something I have been wondering about. Can DVCA be held liable for damages in case of a fire and the fire department wasn't able to respond because of the roads ?

Have recently received an inquiry from a metro D. C. area entity, stipulating anonymity, that has been monitoring the DVCA related cases though the internet since their inception, which is typical of high profile cases with major impact to the health, safety and welfare of the public. These related case inquiries include, but are not limited to the Federal Civil (RICO) and the Greene County General district and the circuit court cases, involving the following named defendants in addition to the DVCA, Lanacotot, Coldren, Kelly, and Dodson. All are of public record and freely available for review. Among questions asked were 1) Is the longstanding conspiracy against Miller involving malicious prosecution, purged testimony, personal threats and vandalism still ongoing? 2) Is criminal road negligence still in evidence? 3) Is DVCA still refusing to keep proper “books of account”, produce annual certified financial statements, hold annual meetings and elections of board members as required by it's corporate by-laws and statute? 4) Is the absence of any contractual obligation or other legal consents by Dogwood Valley lot owners for the $200,000 allegedly owed, and spent, for DVCA “legal defense and “eventually expected to be repaid by the lot owners” as stated in the letter of December 14,2008 signed by president Gary Lowe still being asserted? 5) Have individuals,acting in privy with DVCA attended meetings in which “compensation” to elected officials of Greene County were discussed as “necessary” in order to prosecute Miller, or otherwise affect his removal as a resident of Dogwood Valley? Everyone knows there are problems, but nothing is done; and anyone who tries to act against the board gets a target on their back. So, what is the action that helps that comes from this inquiry?

Some updates!
Delmar has lost his case by default, mostly due to the gross incompetence of his attorney. The transcripts of the motions hearing are in the file at the court house and it is a very interesting piece of reading.
It must have been tough for the judge to have made that ruling but after having beaten Miller over the head about rules of the court this and rules of the court that, it would have been hard for him that have totally thrown out the rules for an attorney who didn't know or follow those same rules.
There is way too much incompetence displayed by Dodson's attorney in these transcripts to even begin to pick out one particular incident but reading the transcripts is like reading a comedy. If Dodson had made half an effort to have shown up in court he could have seen it for himself and realized what a fool he had for an attorney.
I wonder if Dodson realizes that he has a case against his attorney for malpractice? Of course, I guess that would depend on who paid the attorney. If Dodson didn't pay him (as I suspect) then does Gary Lowe have a case for malpractice against him? Or were the results of this exactly as planned?
Now I guess we have to consider what the second attempt to bring false charges against Miller are going to bring? What is even worse is the statements made in front of and to the then canidate for sheriff (now elected sheriff) at the meeting last year, just before Dodson leveled a false complaint against Miller for "hit and run". Does anyone who was at that meeting believe that the attempts at bribery and offers to supply false witnesses are ever going to be overlooked? Will all of this be brought up in the next lawsuit Miller brings against those that simply can't leave him alone?
Now Miller has a new incident of someone on a four wheeler trespassing on his property and assualt with a motor vehicle (trying to run him down). This time by a grown man who should have had more sense, dropping his son off at the end of Millers driveway (as a lookout) while he went in to sabotage some more of Miller's possesions and destroy construction material (and perhaps steal whatever he could lay his hands on). But there was a complication to his plan, Miller was home, his brother and another person were on the hill across from Millers and with the leaves gone could see and hear everything that went on. When Miller caught this guy going into one of the buildings, and started shouting the guy jumps back on his four wheeler and tries to run Miller down. I think I smell another lawsuit, and the videos taken by the cameras on Miller's property are going to support that action.
Wasn't it about time you people wised up and left Miller alone? He was going back to work, now you have killed those plans and put him back on the offensive again. I thought everyone wanted "peace in the valley" CONGRATULATIONS, it only takes one idiot to screw that up!!!

OPPS! Miller was arrested today in Loudon County on a charge from the County of Greene for "disorderly conduct" relating to the actions from my previous post. Now the idiot has made a big BOO BOO, he better hope he wins his false charge against Miller in court, if he doesn't someone else is going to be facing a lawsuit. This idiot trespasses and confronts Miller on MILLER'S property and then files a charge of disorderly conduct against Miller. I guess this guy really is as stupid as everyone thought he was when he mouthed off to the sheriff elect about how much it would cost to have Miller arrested and he could supply up to 25 witnesses to back up any claim. Now I wonder how many witnesses are going to come forward to back up this charge (other than the idiots son).
I would suggest that everyone up here drink bottled water from now on, because it appears that there is something in the water from up here makes people stupid....

Well it appears that Miller has filed another lawsuit for a false arrest complaint being filed. It would look like the people up there would just leave him alone and stay the hell away from his property.
But I guess they don't have anything better to do than spend their time in court with him.

It appears that the DVCA corporation has now sued all of it's members, Although I have yet to have seen the suit as it has not been served and the last time I checked it wasn't available in the clerk's office (the judge is holding it). The question now is why is the judge keeping it under wraps and why hasn't it been served on the members. Is there a little judical hanky panky going on? AGAIN!

Seems someone went to the clerks office this morning and reentered the filing as DVCA "INC", but don't think for a minute that I am not monitoring the VCC for the creation of the "DVCA LLC".
It is nice to see the reaction though. ;>)

Some more news on the Dodson case, it appears that his attorney's plea for a reconsideration has been denied (as of May 3) and Delmar's options have been reduced considerably. Too bad he didn't ask to participate in the mediation that Miller offered to all concerned Dogwood valley lot owners to resolve the tenuous situation there. He may have walked away all matters resolved with no repercussions.
I wonder if Curtis will have the same regrets a later date.

IS there a negotiated resolution for Dodson going to be available in the near future?
A question comes to my mind, why is Miller trying to resolve these issues with Dodson and Wysel and DVCA without further litigation and the above three seem intent on ignoring Miller's offers of an olive branch?
Is there another round of False charges heading Miller's way now that he is moving back home after being out of the state for a year?
