Springfield, MO and Anti-Gay Flirting Laws - Why the Kiss In Really Matters

Full story: tinyurl.com

Organizers of the Great Nationwide Kiss In understood the importance of a kiss when they first decided to turn it into a movement. They repeatedly told the stories of: the two men in El Paso who were kicked out of Chico’s Tacos in El Paso, Texas for kissing; the two lesbians kicked out of Rolling Oaks Mall in San Antonio, Texas for kissing; and the two young mean forcefully detained for a kiss on a popular promenade is Salt Lake City which is now owned by the Mormon Church.

What is up with that!? Did Springfield all of a sudden forget that all sodomy laws in the US were overturned by Lawrence vs. Texas! They claim sodomy law, but it has all been ruled unconstitutional!

Why do so many people accept unconstitutional laws that one needs a permit to exercise their First Amendment rights ?

You have GOT TO BE KIDDING ME.

A kiss has NOT A DAMN thing to do with ANAL SEX......NONE, NADA, NOTHING!

And from what I gather from the "SHOW ME STATE".....they need to be shown that.

IF LAW ENFORCEMENT EVEN ATTEMPTED TO ARREST FOR A KISS AND CITED THE SODOMY LAW.......IT WOULD BE IN DIRECT VIOLATION OF THE DECISION BY SCOTUS IN 2003.

Sort of to bad I don't live there......I might consider doing it ANYWAYS.....lol

Apparently it is America, unless you are gay and then it is like in Iran or some such place. This is a joke , if it was not so sad.

Sometimes, a kiss is just a kiss. It's not a solicitation to have sex. To claim otherwise is an absurd interpretation of the law. Missourians should turn out and pucker up.

The Religious Right does not give a damn about the Constitution of the USA. They are no better than radical Islamists.
They cannot be reasoned with because they claim their power comes from a "higher authority."
They have infiltrated many local and state governments and willingly pass laws they know are unconstitutional political landmines. They ruin any politician that goes against their agenda with smear campaigns filled with lies.
It is time for this behavior to be publicized for exactly what it is: NAZISM....and bullying! It took a world war to stop the German Nazis. Bullies back down when stood up to. I can only conclude that the Religious Right wants war. I, for one, am ready to give it to them!

Ya, the "Show Me State". It's kinda negitive motto sometime. LOL. I live in Kansas City, MO. I will kiss my partner wherever I want to. I ususally don't make a scene out of it, just do it. Don't get all suck face about it, just a little kiss.

The law stated didn't say anything about sodomy being a crime, just what leads up to it. However, given the reasoning behind sodomy laws being deemed unconstitutional, this law, if held up to the same light, should also be deemed unconstitutional. If it was a typical "PDA" law, applied to everyone, it would be different. It is possible this law was left on the books after the sodomy laws was taken off and no one's thrown a big enough fit over it, so there it stays. All of these types of laws need to be gone after publicly, let the people keeping them on the books know, it's not going to be put up with.

I should go visit my friends there again and make a scene...
Oh wait, Springfield is one of the biggest sh*tholes on Earth and I never plan on going back.

It's a sprawling suburb in the middle of nowhere, centered around nothing. The people must have nothing better to do than police each other's flirting.

This law seems totally unconstitutional. Secondly, how can someone actually enforce this law and prove that 2 people of the same-sex were flirting? Next, what does kissing or flirting have anything to do with sodomy? Not a thing. Lastly, sodomy laws were ruled unconstitutional, so I doubt this is constitutional.

I doubt this law is really being enforced or is in effect, but anyway this law here needs to be known and put out there, so it can be changed. And overall, the fact is GLBT citizens are a legal, tax paying part of this country, and we have every right to kiss, hold hands and be ourselves in public and not have to worry about discrimination. It is past time we take a stand and say no to the bigots trying to shove us in the closet and pretend we aren't there. We are here, and it is time the bigots get over it.

I mean exactly.......a kiss is a kiss......nothing more and sometimes nothing less.

I think the "SHOW ME STATE" just might need to be shown that....lol

It should be noted that this is not an exact reprint of the article. At this time, it is unknown whether or not the person applied for a permit or was just advised that the law existed.

Either way, fear of prosecution under the law was enough to stop an event in Springfield.

The Lawrence decision covers private consensual conduct, not public conduct. Anti-sodomy laws remain on the books in many states, and could be considered enforceable against public conduct.

The Lawrence decision doesn't directly invalidate the Springfield law. It would be enforceable until such time as it's challenged before the court and ruled unconstitutional on its own.

Having said that, it seems unlikely that authorities would attempt to enforce the law, because they know they'd be inviting a media sh*tstorm in doing so. Not to mention the risk of having the courts invalidate a law that operates as a nice scare tactic for them to use against gay folk who might otherwise dare to exercise their equality.

Just to be clear: I don't think there's any chance of this law surviving if it were challenged in court.

Until that happens, it is enforceable.

well kissing in public is NOT illegal anywhere, and I would like to know how people get married there if they do not get married in a church?
weddings end with a kiss....and unless every single wedding there is performed inside a private home or church, then every couple would have broken the law when they kissed their spouse!!
we're gonna need to send a lot of handcuffs to springfield!
gay people..get out your cell phones and start snappin pics!!
gonna send some straighties to prison!!
