I can see the prosecutor offering a deal with time served.
With the search and any evidence from the search thrown out a case will be very hard to build. The person has already done about 13 months in jail, figure another 2 or 3 months while refiling, and motion play themselves out. Prosecutors would rather offer a deal and get a conviction. Than to re-file lose the case, and have the state on the hook for monetary damages for the time spend in jail.(which is about $45k a year for false imprisonment) |
