If a judgment was filed against him for this $60,000 debt obligation, then this debt should be settled through his estate. You need to talk to an attorney.

If a person's primary income is SSI benefits, it is highly unlikely they would leave any estate at all, let alone anything approaching $60,000. What's the old saying - you can't get blood out of a turnip.

SINCE YOU know for a fact aboout all of us women not wanting to work (BY THE WAY I work one full-time and two-part time jobs) you must be one of those wonderful sperm donors that have quite a few children out there without a father!!! I work to support my sons and my niece so that my ex and her father can go out and drink themselves into oblivion and make more children live without fathers!! Wise up and take responsibility for what you create or else get a vasectomy and you can chase all the skirts you want and never worry about anyone chasing you in return. Have a great day Sumguy!!!

I read somewhere about the wv state law on child support, that the payments are based on BOTH parents' income....is this correct? I read that they take the mother and the father's monthly incomes together and some how figure on how much the child would recieve if the parents were still together...Anyone know if this is correct or if only the father's income is considered?

It is based on the income of both parents. If the mom doesn't work, the will ENCOURAGE you to get a job. When I got divorced I was not working (I had been a stay at home mom) but they still put me down at minimum wage because they said I would be going to work.

WV child support calculators are available online to help estimate the amount of support in which you would receive. As for guidelines, try the child support enforcement site or office.

the stupid child support enforcement website doesnt have the guidelines anywhere on it, though it really should...and that alllaw calculator i really believe is very inaccurate.

Yes - both parents are required to support the child. If you work, you will be required to contribute to the support of your child. If you have a set amount now, your ex can take you back to court and have his part reduced if you get pay increases.

mine hasn't paid for over 90 days. he still has his license. as a matter of fact i've been told i have to have another hearing before they can do anything at all about it. but first they have to modify it. that cannot be done until december. then if he still isn't paying i have to file for a hearing. this system is horribly broken. we need to get the kids faces out there. tell their story, let the public know who isn't supporting their children. im sure you can't name names, but you can give enough info for the public to figure it out. the children are the hidden shame of wv. not cared for by their father's (or mother's ordered to pay) and the government could care less.

They don't joke about that one. There is also a law in WV, that if no court action has been taken in 10 years, it nullifies the order, meaning you are no longer owed anything.
As for Child Advocates, they don't know what they are doing. They really need to overhaul that system big time, not just in WV, but nationwide.
I know someone who has given the information to get their child support from the taxes and they were told "can't do it the way the taxes were filed", BULL.
Unfortunately the only suggestion is for you to get a lawyer on your own, because the lawyers for child advocates do not represent you but represent the state.

I agree. But overall, these problems stem from an over reliance on the court system. You and your partner should make a commitment to each other and to your child before the child is born. If your child was an accident or you were not married, it is no wonder the man is unwilling to help.

You expect the government to step in and make him pay. You should be able to solve your own family problems. The entire child support system only exists to generate revenue for the states and create worthless jobs. Perhaps women would be more careful who they procreated with if they did not believe their child would guarantee them an untaxed lump sum every month for the next 18 years.

they consider both the mother and father's pay, if the child of the mom and dad is below school age they will not include salary for mom; if dad doesn't have a job, then minimum wage will be contributed to the father.

child support worker's work very hard to do the right thing and help people, it is a very hard job. maybe the people complaining might want to deal with very angry individuals every day. no one is happy no matter what you do.

it's not about mom and dad. it's about the children

When I divorced, they included my income for my 3 year old - and I was only working temp jobs. My husband did not want me to work & refused to let me finish my college degree so I had to take temp jobs to support my daughter & myself. He did not pay anything for about 6 months until the judge ordered some support - but even thought I only had temp jobs (until I later got a FT job), they still considered my income at 40 hours a week at min. wate. As for not being happy, no - I was not at the way child support in WV works. I had to call several times and one of the women right out told me that if I wanted better results to get a lawyer & not go through them - plus she also LIED to me about what was in the judges order. I tried to tell her I was looking at a copy of it at the time and she called me a liar - When I am finished with this system, I will write a letter to the govener about what a waste of taxpayers money the child advocate system is and that people who want to work & have half a brain should be the ones working there - not the doless ones who are there now. I have written proof of the lies told to me and I will forward that to the govener once I am through dealing with them - sad thing is that if you cross them while you need them then you are screwed to the wall!

for all the ladies im sorry to hear about your trouble with the men in your past. i have a quick question my question is i was in 2 hit and run accients 2 years ago as well work related injury which i injured my mid-lower back also neck injury and so fourth but my main issue is if i win my settlement with social security i will only be collecting ssi only can child support service garnish money from ssi, i know ssdi they can. because i always make sure i pay my child support bill so i cant say im a deadbeat father but i always try to make sure to send my son a bit of money when ever i get any to make sure he has things for school and so forth. but at least if i do get approve for my ssi i got the best news once i get into my own place my ex told me she said if you want your son to live with you he is more than welcome i was like very happy that she open up to let me be part of his life. another thing i always do i make sure i always call him at least 2-3 times a week to let him know i always think of him. its been a couple of years since the last time i seen my son. i felt like my ex did more harm to my son who is now 14 years old right before i move back to northern califorina to live with my father and step mother due to my condition was getting wrose off i had all the time in the world to see my son but my ex did not want me to come over to see him period which rip me apart to not seeing him or even spending time with him like taking him to the movies or going out lunch for the weekend. but you can say what ever about me i might not been the best father but i always try to make a honest effort.
