some are just ignorant

thanks for the notice, but apparently the ones on here who need to know that, just didn't even read your post. Like all who are bashing everyone and their brother, they need to know that the people they trash on here, can actually file a complaint against them for slander, defamation of character, etc. Like the lawyer in Lexington is doing right now.

You all who are doing all the slandering best have the proof of what you are accusing people of.

don't think it is all that important considering there is bigger and better things in this life to worry about. Good grief look around you, no one gives a crap about Topix other then a few with a closed mind to the realities of life. Most don't give a crap what is posted 1 min ago,let alone in a week, month, year, 10 yrs.
Who is stupid enough to waste their time, money and resources on a website where all us crazy people go to unwind.
Topix makes for good universal health care plan, you can log in to talk out issues, don't need an appointment, and free to anyone who choses to go there.

So not true/true. There are a couple of excellent ways to hide yourself at home. If you are super paranoid use a laptop and someone elses bandwidth. Like at a internet cafe, several here in town, many hotels are good too. With that said you can be traced if you are at home w/o very good anonymity protection. The previous poster is the truly ignorant one. The lawyer is Lexington is taking easy money from a sucker. 2K at least for a retainer fee to start. Some are ignorant prove you didn't suck me off. Get the point now?

It will be interesting to see what kind of lawyer is willing to take one of these cases. It is my understanding that they generally only take cases where they can actually make some money.

OK... for someone to be convicted of slander or libel several things have to be going on.

First, the statements made must be false.

Secondly, the party making the claim must prove injury due to the statements.

Injury is usually involved with finances. For instance, delivering an accusation to the person's employer.

Hurt feelings aren't good enough.

Third, you must prove malicious intent.

Of course, that third one would be fairly simple on here. LOL

Even when the facts are there and the case is good it normally turns into a civil matter and the awards are so small that no ethical attorney would advise a client to spend the time pursuing it.

The obvious exception is when slander or libel affects a person's ability to earn a living.

So relax. This stuff ain't nice, but the thought police probably aren't going to come after you for saying that Ms. X is a whore.

LOL

You would have to have a lot of money at your disposal, and a lot of time, to go through all that has to be done just to file a suit against someone for slander or defamation. It's a long drawn out process. And the chances of someone having a legitimate case that would pay off, are very slim.

I wish your statement were true, and it is to an extent. But I think what is so wrong and dangerous is that you can live a good clean life, and some of these Topix postees can just throw your name in the pot and start vicious rumors with no basis to the rumors at all. Those are the ones who need to be identified and dealt with. My main goal on signing on to the Somerset forum was to see what was going on in my old home town. I really didn't want to know this much however. Anyway, think I'll just curl up and hibernate on this cold morning and read a good book. Have a wonderful Christmas, Pulaski Countians. Let's hope the true Christmas Spirit becomes more apparent on this site. May God bless you abundantly this coming New Year.

That's not always true. I know of several lawyers that will just take your money whether they think you will win or not.

Topix is freedom of speech, which cannot be taken away. Someone would have to prove that someone else committed libel(wriiten text), not slander(verbal text). Many things posted on here can just be someone's opinion. Unless you make an accusation like to say someone has aids and they don't. Maybe that they stole something and didn't. For the most part topix is just a place where people like to vent, and nobody takes anything serious.

A person would also need a court order to trace anything, which means that a judge would have to see a need to issue a court order. I don't see anyone on this forum sueing anyone else.

People make false accusations all over the place. What happens if they are lying? Nothing. The 2 links that Stephanie provided are rather old. It would be interesting to know the outcome from that lawsuit. My bet is nothing. I never seem to hear the rest of the story on so many things.

What happened with the lying piece of human garbage (Crystal Gail Mangumthat) that accused the Duke lacrosse players of raping her? She did it right out in the open, not behind a screen name. Didn't she write a book in the end and make money from the ordeal. If they can't put that piece of crap in jail for ruining those boys lives what can they do to someone lying on here?

What do the terms of service have to do with this thread? If anyone wants to read it they can click on themselves.

Somebody show just one case, just one where anybody got sued and lost because of what they posted on topix. I doubt that a case such as that exists.
